Handling of Candidates Violating Exam Regulations according to Circular 23/2017/TT-BGDDT

Regulations issued together with this Circular specifically stipulate the handling of candidates violating exam regulations as follows:

1. Candidates violating exam regulations must have a record created, handled and notified to the candidates.

2. Forms of handling:

- Admonishment for candidates who commit a first-time offense: peeking at or exchanging exam answers with other candidates. The admonishment form will be determined by the exam proctor in the record created;- Warning for candidates violating one of the following offenses:- Have been admonished once but continue to violate exam regulations at the admonishment level in the exam session;- Exchanging exam answers or draft papers with other candidates;- Copying others' exam answers or allowing others to copy their exam answers.

The form of disciplinary warning will be determined by the exam proctor in the record created, along with evidence (if any).

- Suspension of exam for candidates violating one of the following offenses:- Have been warned once but continue to violate exam regulations at the admonishment or warning level in the exam session;- Bringing unauthorized documents or items into the exam room;- Taking the exam question out of the exam room or receiving answers from outside into the exam room;- Writing or drawing on the exam paper any content unrelated to the exam;- Acting to incite, threaten exam officials or other candidates.

The exam proctor will create a record, confiscate evidence (if any), and report to the Head of the Exam Supervisors. The Head of the Exam Supervisors will report to the Chairman of the Exam Council to decide the form of exam suspension.

Suspended candidates must submit their exam papers, question papers, and draft papers to the exam proctor and leave the exam room immediately after the decision and only leave the exam area after 2/3 of the exam duration has passed.

- Deduct exam scores:- Candidates admonished during any skill exam will have 25% of the total score for that skill exam deducted;- Candidates warned during any skill exam will have 50% of the total score for that skill exam deducted;- Exams that are intentionally marked by the candidate found during grading will have 50% of the total score deducted.- Assign a score of 0 (zero) for one of the following cases: The exam copied from unauthorized materials brought into the exam room; The exam has handwriting from two or more people; Parts of the exam written on draft paper, non-compliant paper.- Cancel exam results for candidates:- Suspended from the exam;- Writing or drawing on the exam paper any content unrelated to the exam;- Having someone else take the exam or do the exam for them in any form; altering, adding to the exam after submission; submitting someone else's exam.

- Prohibited from participating in the national foreign language proficiency assessment exam for the next 2 years for offenders committing one of the following violations:- Having someone else take the exam or do the exam for them in any form;- Disrupting, sabotaging the exam; assaulting exam organizers or other candidates.

3. For other violation cases, depending on the nature and severity of the violation, they will be handled according to current regulations.

4. Data from surveillance cameras is one of the official bases for considering handling exam regulation violations.
