Ha Noi, Vietnam: To issue land price adjustment coefficient for 2024

On July 18, 2024, the People's Committee of Hanoi City, Vietnam issued Decision 45/2024/QD-UBND and Decision 46/2024/QD-UBND on the issuance of the land price adjustment coefficient for 2024 for cases applying the coefficient as stipulated by law as a basis for collection of land use fees. To be specific:

Case 2:

- The coefficient for adjusting the price of agricultural land, forestry land, land with water surface used for aquaculture is: 1.0

- The coefficient for adjusting the price of agricultural land (including garden land, ponds adjacent to the homestead land) as a basis to determine the difference between the land use levy for new purposes and the agricultural land use levy: K = 1.0

Note:

- Case 1: The coefficient for adjusting the land price as stipulated by law as a basis for:

+ Collecting the land use levy when land is allocated without auction;

+ Collecting the land use levy when an organization is recognized the right to use land, changes the land use purpose;

+ Calculating the value of land use rights when equitizing a state-owned enterprise where the equitized enterprise uses land allocated by the State with the collection of land use levy;

+ Collecting the land use levy when selling social housing;

+ Determining the starting price for auctioning the land use rights of homestead land.

- Case 2: The coefficient for adjusting the land price for cases applying the coefficient as stipulated by law as a basis for:

+ Collecting land rent;

+ Determining the starting price for auctioning land use rights for lease;

+ Collecting the land use levy for households and individuals recognized by the State the right to use land, allowed to change the land use purpose for the area of homestead land exceeding the limit;

+ Calculating the value of land use rights when equitizing a state-owned enterprise where the equitized enterprise uses land leased by the State.

- Non-agricultural business land: The coefficient for adjusting the price of non-agricultural business land.

- Commercial service land: The coefficient for adjusting the price of commercial service land.

- Residential land exceeding limit: The coefficient for adjusting the price of land used as a basis for collecting land use levy for households and individuals recognized by the State the right to use land, allowed to change the land use purpose for the area of homestead land exceeding the limit as stipulated in Clause 3, Article 3 Decree 45/2014/ND-CP on collecting land use levy.

- In cases where the land auction is conducted in locations with the same area or street with different levels of benefits, land use coefficient (construction density, building height, etc.) differs from the general average of the area or street: The District People's Committee has the responsibility to review and report to the Department of Finance for summation, construction, and consultation on the adjustment of the issued land price adjustment coefficient according to regulations.
