Recently, the Ministry of Home Affairs of Vietnam issued the Circular No. 1/2021/TT-BNV issued on January 11, 2021 guiding the organization of the election of deputies to the 15th National Assembly and People's Councils at all levels for the 2021-2026 term in Vietnam.
According to Article 3 of the Circular No. 1/2021/TT-BNV of the Ministry of Home Affairs of Vietnam, the establishment, structure, composition, and duties, powers and operating principles of local electoral organizations are stipulated as following:
1. The establishment, structure, composition, and duties, powers and operating principles of local electoral organizations are implemented in accordance with provisions of Articles 21, 22, 23, 24, 25, 26, 27 and 28 of the Law on Election of Deputies to the National Assembly and People's Council of Vietnam.
- For island localities that do not have commune-level administrative units, the establishment of organizations in charge of local elections shall be carried out by the district-level People's Committees after reaching agreement with the Standing Committee of the People's Council (if any) with the Standing Committee of the Vietnam Fatherland Front Committee at the same level to decide on the structure and composition of the organizations in charge of elections in the localities under their management.
- For the constituency of National Assembly deputies and commune-level People's Councils with only one polling station, separate Election Boards and Election Teams shall still be established; members of the Election Board may participate as members of the Election Team.
- For units of the people's armed forces, it is defined as a separate voting area decided by the unit's command. In case a unit of the People's Armed Forces is stationed in the area of 02 or more commune-level administrative units, the unit commander shall discuss with the People's Committee of the district where the army is stationed and request the appointment of the People's Committee of one of the following units: Commune-level administrative units shall coordinate in making the list of voters and handing out cards to voters at units of the people's armed forces.
2. The agency competent to set up an organization in charge of the election selects people with good political and moral qualities, trusted by the masses, knowledgeable about the law and experienced in conducting electoral work to join electoral organizations.
3. In case a member of the election organization dies, is disciplined, prosecuted for penal liability or for other reasons leading to the vacancy of a member in charge of the election organization, based on the specific situation of the election organization in each locality, the People's Committee, after reaching agreement with the Standing Committee of the People's Council and the Standing Board of the Vietnam Fatherland Front Committee at the same level, shall decide to change or supplement members of the organization in charge of elections at the same level before election day.
