Guidelines on the Procedure for Revoking and Reissuing Professional Editing Certificates

This content is detailed in Circular 01/2020/TT-BTTTT, which stipulates and guides the implementation of certain provisions of the Publishing Law and Decree 195/2013/ND-CP dated November 21, 2013, of the Government of Vietnam, detailing some provisions and measures to implement the Publishing Law.

To be specific:, Circular 01/2020/TT-BTTTT stipulates the order, procedures, and methods for revoking the editorial practice certificate as prescribed in Clauses 3, 4, and 5, Article 20 of the Law on Publishing, to be implemented as follows:

Firstly, the order, procedures, and methods for revoking the editorial practice certificate as prescribed in Clause 3, Article 20 of the Law on Publishing:

- Determining that the editor falls into the category subject to revocation of the editorial practice certificate as prescribed in Clause 3, Article 20 of the Law on Publishing must be documented by the Publishing, Printing, and Distribution Department;- Within 05 working days from the date of documenting, the Director of the Publishing, Printing, and Distribution Department must issue a decision to revoke the editorial practice certificate;- From the date of the decision to revoke the editorial practice certificate, the editor is not allowed to edit manuscripts, sign their name on publications, and is responsible for returning the editorial practice certificate to the Publishing, Printing, and Distribution Department.

Secondly, the order, procedures, and methods for reissuing the editorial practice certificate as prescribed in Clause 4, Article 20 of the Law on Publishing:

- After 02 years from the date of revocation of the editorial practice certificate, the editor can request the Publishing, Printing, and Distribution Department to reissue the editorial practice certificate. The application for reissuance of the editorial practice certificate can be sent directly or via postal or courier services to the Publishing, Printing, and Distribution Department;- Within 10 days from the date of receiving a complete application, the Publishing, Printing, and Distribution Department is responsible for considering the reissuance of the editorial practice certificate to the editor; if not reissued, a written response stating the reason must be provided.

Thirdly, the order, procedures, and methods for reissuing the editorial practice certificate as prescribed in Clause 5, Article 20 of the Law on Publishing are as follows:

- No later than 15 days from the date the editorial practice certificate is lost or damaged, the editor must submit an application for reissuance of the editorial practice certificate. The application comprises 01 (one) set sent directly or via postal, courier services to the Publishing, Printing, and Distribution Department including: An application for reissuance of the editorial practice certificate; the original editorial practice certificate if it is damaged;- Within 05 working days from the date of receiving a complete application, the Publishing, Printing, and Distribution Department is responsible for considering the reissuance of the editorial practice certificate to the editor; if not reissued, a written response stating the reason must be provided.
