The following article pertains to the leasing of land for narrow, intercalated parcels in Lam Dong from February 15, 2025, as stipulated in Decision 08/2025/QD-UBND.

Guidelines  on  Leasing  Land  for  Small,  Irregular  Parcels  in  Lam  Dong  from  February  15,  2025

On February 5, 2025, the People's Committee of Lam Dong Province issued Decision 08/2025/QD-UBND regulating the review, public announcement, and listing of small, intercalated parcels and the allocation, leasing of such parcels in Lam Dong Province.

In Decision 08/2025/QD-UBND, the People's Committee of Lam Dong Province provided guidance on the allocation, leasing of small, intercalated parcels in Lam Dong Province as follows:

- The allocation, leasing of land shall be carried out in accordance with Clause 2, Clause 3, Article 47 Decree 102/2024/ND-CP and other relevant legal provisions, specifically:

+ Principles of land allocation, leasing for small, intercalated parcels:

++  Priority  shall  be  given  to  using  small,  intercalated  parcels  managed  by  the  State  for  public  purposes.  If  they  cannot  be  used  for  public  purposes,  the  land  may  be  allocated  with  land  levy,  or  leased  out  to  the  adjacent  land  users;

++  In  cases  where  two  or  more  adjacent  land  users  request  to  use  small,  intercalated  parcels,  the  decision  shall  be  based  on  the  planning  and  actual  land  use  conditions  of  the  adjacent  users;

++  The  allocation,  leasing  of  small,  intercalated  parcels  to  adjacent  land  users  shall  be  conducted  after  local  authorities  have  reviewed,  publicly  announced,  and  consulted  with  local  residents;

++  The  allocation,  leasing  of  such  parcels  shall  be  based  on  a  land  request  application  from  the  adjacent  user  and  must  be  carried  out  openly,  transparently,  and  democratically;

++  After  land  is  allocated  or  leased  by  the  State,  adjacent  land  users  must  perform  parcel  consolidation  procedures  as  regulated;

++  Ensure  the  rights  to  the  adjacent  parcel  in  accordance  with  land  laws  and  civil  laws;  prevent  the  emergence  of  land  disputes  or  complaints.

+ The land use term when the State allocates, leases small, intercalated parcels to adjacent users shall be aligned with the use term of the parcel that the adjacent user is utilizing. If the allocation, leasing involves changing the use purpose of the adjacent parcel and the small, intercalated parcel, the land use term is determined under Articles 171 and 172 of the Land Law 2024.

- Procedures for land allocation, leasing follow the administrative procedure processing in the land field as prescribed by the Provincial People's Committee.

Refer to the Decision 08/2025/QD-UBND effective from February 15, 2025. Decision 21/2022/QD-UBND by the Provincial People's Committee regulating the review, public announcement of small, intercalated parcels directly managed by the State, gathering public opinions, and the public allocation, leasing of such parcels for public purposes or to adjacent users in Lam Dong Province will cease to be effective from the date Decision 08/2025/QD-UBND takes effect.
