On February 03, 2016, the Supreme People's Court issued Circular 02/2016/TT-TANDTC to provide specific guidance on how to determine the successful candidates in the selection examination for judges.

Circular 02 stipulates that candidates who pass the selection exam, promotional exam for the position of Judge must meet the following conditions:

- Take the exam and have all the exam papers for the subjects; each exam paper must have a score of 5/10 or higher according to the scoring scale of each subject.- Have one of the highest exam results in descending order within the quota for Judges being selected or promoted.- In case there are 02 or more candidates with the same final exam results as per Clause 2 of this Article and the quota for Judges being selected or promoted is insufficient for all those candidates, the selected candidate will be the one with the higher score on the written exam. If the scores on the written exam are equal, an additional exam or the Chairman of the Examination Council will consider other conditions and standards to decide the selected candidate.
