The following article discusses the handling of individuals participating in exam organization who violate the High School Graduation Examination regulations in Vietnam from 2025, as stipulated in Circular 24/2024/TT-BGDĐT.

On December 24, 2024, the Minister of Education and Training of Vietnam issued Circular 24/2024/TT-BGDDT regarding the Regulations for high school graduation exams.

The handling of individuals involved in the organization of exams and related individuals violating the high school graduation exam regulations is executed according to the provisions of Article 56 of the Regulation attached to Circular 24/2024/TT-BGDDT as follows:

- Officials and public employees participating in exam organization found to have violated exam regulations (detected during or after exams) will be suspended from exam-related duties and their managing body will be called upon to apply disciplinary measures according to the laws concerning officials and public employees as follows:

+ Reprimand for first-time violators of actions below the thresholds stipulated in points b, c, d, clause 1, Article 56 of the Regulation attached to Circular 24/2024/TT-BGDDT while performing duties;

+ Warning for those committing one of the following offenses: Allowing candidates to cheat and bringing unauthorized materials, items into the exam room as constituted in point b, clause 4, Article 21 of the Regulation attached to Circular 24/2024/TT-BGDDT; grading improperly against guidelines or with significant errors in score calculation; creating exam questions outside the stipulated content in clause 2, Article 4 of the Regulation attached to Circular 24/2024/TT-BGDDT; incorrectly transmitting exam data structure, not adhering to deadlines or compliance of the Ministry of Education and Training;

+ Depending on the violation severity, demotion, reclassification, dismissal, or transfer to other duties may be imposed on those committing one of the following offenses: Designing exam questions misaligned with the scientific content of the test or subject; directly solving exams or guiding candidates during exams; transferring a candidate's test paper to another; fraud in grading, non-compliance in scoring, exceeding or lowering a candidate's score thresholds;

+ Mandatory dismissal or criminal prosecution for individuals committing one of the following violations: Leak of exam questions or answer sheets out of the exam area during exams; trading exam questions; revealing exam tags or seals; modifying, adding, or removing from a candidate’s submission; intentionally altering scores on test papers, grading records, or on score sheets; swapping tests, exam seals or scores of candidates; fraudulent alteration of academic records or candidates' documents;

+ Individuals losing candidates' test papers during collection, transportation, safety, marking or involved in other violations related to exam organization shall face disciplinary measures as stated in Article 56 of the Regulation attached to Circular 24/2024/TT-BGDDT depending on the nature and severity of the violation.

- Officials, public employees not directly involved in exam administration but engaging in acts like impersonating candidates, extracting questions, feeding answers during exams, spreading misinformation negatively impacting exams, or disturbing order at exam venues shall face administrative penalties and be recommended for dismissal.

- Individuals involved in exam organization and those related who are not officials and public employees found violating exam regulations (detected during or after exams), depending on severity, will face penalties from competent authorities pursuant to administrative penalty regulations and labor law; temporary suspension or expulsion might be imposed (if they are students, trainees) for behaviors stipulated in points b, c, d, e, clause 1, Article 56 of the Regulation attached to Circular 24/2024/TT-BGDDT.

- The forms of handling offenses prescribed in clauses 1, 2, and 3, Article 56 of the Regulation attached to Circular 24/2024/TT-BGDDT are decided by authorized agencies, organizations according to the regulated procedures. Besides the mentioned disciplinary forms, competent agencies may prohibit appointment to exam-related tasks from 1 to 5 years.
