Guidelines for supplementing the Certificate of registration for the development of self-produced, self-consumed rooftop solar power in Vietnam

The following article discusses the addition of the Certificate of registration for the development of self-produced, self-consumed rooftop solar power in Vietnam as stipulated in Decree 135/2024/ND-CP.

On October 22, 2024, the Government of Vietnam issued Decree 135/2024/ND-CP regulating mechanisms and policies to encourage the development of self-produced, self-consumed rooftop solar power in Vietnam.

According to the regulations in Article 13 of Decree 135/2024/ND-CP, when there is a change in information regarding the owner of the facility, information on power scale, time of installation completion, the form of choosing to generate, and sell excess electricity of self-produced, self-consumed rooftop solar power recorded in the Certificate, adjustments and supplements will be made according to the following regulations:

- Documents carried out in accordance with Article 10 of Decree 135/2024/ND-CP.

+ Receiving agency: The agency receiving the registration documents for the development of self-produced, self-consumed rooftop solar power as stipulated in Clause 1, Article 9 of Decree 135/2024/ND-CP.

+ Registration documents include:

++  Registration  form  according  to  Form  No.  01  in  the  Appendix  issued  together  with  Decree  135/2024/ND-CP

Form No. 01

++  Households,  individual  homes  provide  documents:  Design  drawing  of  the  self-produced,  self-consumed  rooftop  solar  power  installation;  a  copy  of  the  construction  permit  of  the  facility  (if  any)  in  accordance  with  the  law in Vietnam;

++  Other  subjects  provide  documents:  Design  drawing  for  the  installation  of  self-produced,  self-consumed  rooftop  solar  power;  copies  of  investment  policy  decisions,  construction  permits,  fire  safety  acceptance,  construction  completion  certificates,  and  environmental  protection  documents  issued  by  the  competent  authority  (if  any)  in  accordance  with  the  law in Vietnam.

- Submission methods are carried out according to Article 11 of Decree 135/2024/ND-CP: Organizations and individuals registering for the development of self-produced, self-consumed rooftop solar power connected to the national grid compile documents in accordance with Article 10 of Decree 135/2024/ND-CP and submit according to one of the following methods:

+ Direct submission at the headquarters of the receiving agency. Uncertified copies of accompanying documents must be accompanied by the original for comparison. One set of documents required.

+ Mail submission. Copies of accompanying documents must be certified. One set of documents required.

+ In case of submission via the electronic portal of the receiving agency, follow the form of online public services.

- Procedures for adjusting and supplementing are carried out according to Article 12 of Decree 135/2024/ND-CP

+ In case the documents are incomplete according to the regulations or do not meet the conditions prescribed in Clause 2, Article 9 of Decree 135/2024/ND-CP, within 3 working days from the date of receiving the documents, the receiving agency shall issue a notice to return all documents for the organization or individual to supplement and resubmit according to regulations;

+ In case the documents are complete and valid, within 10 days from the date of receipt, the receiving agency is responsible for issuing the registration certificate for development according to Form No. 02 in the Appendix issued together with Decree 135/2024/ND-CP. If the requirements are not met, the receiving agency issues a written notice stating the reasons. During the resolution process, the receiving agency for registration development has the responsibility to determine the receipt time in chronological order to resolve in accordance with regulations;

Form No. 02

+ After receiving a valid registration file, the receiving agency sends the file to the local electricity unit to provide opinions on whether the proposed development of self-produced, self-consumed rooftop solar power causes or does not cause overload to the area's transformer stations, low-voltage and distribution grid where registration is proposed, and whether the proposed capacity meets or does not meet the current load (based on the electricity consumption in the past 12 months). The electricity unit must review, resolve, and send feedback to the receiving agency within a maximum of 7 days.

More details can be found in Decree 135/2024/ND-CP, which comes into force in Vietnam from October 22, 2024.
