Recently, the Government of Vietnam issued Decree 221/2013/ND-CP regulating policies on the application of administrative handling measures for mandatory rehabilitation centers.
Guidelines for receiving persons subject to administrative penalty of compulsory rehabilitation in rehabilitation centers in Vietnam (Illustrative image)
According to Article 16 of Decree 221/2013/ND-CP, procedures for receiving persons subject to administrative penalty of compulsory rehabilitation in rehabilitation centers are as follows:
Upon receiving an person subject to administrative penalty of compulsory rehabilitation in rehabilitation centers, the center must check and compare the person, their identification card (if available), or fingerprint with the information in the dossier specified in point 2 below to ensure the correct person is subject to administrative penalty of compulsory rehabilitation in rehabilitation center. A receipt protocol must be created, documenting the person's health status, documents, dossier, personal belongings, and items. The protocol is made in 04 copies, with each party retaining 01 copy, 01 copy sent to the District Department of Labor - Invalids and Social Affairs for dossier keeping, and 01 copy sent to the District People's Court which issued the decision.
The dossier for receiving an person subject to administrative penalty of compulsory rehabilitation in rehabilitation center includes:
- Decision on applying the measure of compulsory rehabilitation in rehabilitation center by the District People's Court;
- Copy of the protocol for executing the decision on compulsory rehabilitation in rehabilitation center provided by the District Police Authorities;
- Copy of the summary of the person's background subject to administrative penalty of compulsory rehabilitation in rehabilitation center provided by the dossier-preparing agency.
