Guidelines for Receiving and Resolving Administrative Procedures in the Electronic Environment from May 22, 2020

Electronic dossiers for administrative procedures consist of electronic documents and materials submitted or supplemented by organizations or individuals carrying out administrative procedures to competent authorities as prescribed, or electronic documents and materials circulated between competent agencies and organizations during the process of receiving and resolving administrative procedures.

The process of receiving and resolving administrative procedures in the electronic environment, applicable from May 22, 2020, is stipulated in Article 11 Decree 45/2020/ND-CP. To be specific:

1. The National Public Service Portal or ministerial, provincial Public Service Portals receive requests and perform automatic technical checks. If the dossier includes all required components and meets technical standards, an automatic response confirming successful submission is sent, along with a notice of the official receipt time.

2. Officials and public employees log in to the ministerial, provincial electronic one-stop information system and check the electronic dossiers sent by organizations and individuals. The content of the dossier check includes:

- Verifying the accuracy of the information in the application forms and declarations through information retrieval from information systems and databases that are ready to connect and share information with the National Public Service Portal, ministerial, provincial Public Service Portals, and the ministerial, provincial electronic one-stop information system;- Checking the digital signature information to ensure the authenticity, validity, accuracy, and integrity of the dossier components uploaded, referenced, and the components requiring electronic authentication; the digital signature verification is performed according to the provisions of the Law on Electronic Transactions.

3. After checking, if the conditions for receipt are met, officials and public employees accept the dossier, issue a code to the administrative procedure dossier, and process the dossier according to the procedures stipulated in Chapter III of Decree No. 61/2018/ND-CP dated April 23, 2018, of the Government of Vietnam, and other relevant legal regulations. In case the dossier is incomplete or non-conformable, officials and public employees notify the organization or individual through their account on the National Public Service Portal, ministerial, provincial Public Service Portals, and other registered information channels, providing comprehensive, specific instructions so that citizens and organizations can supplement the dossier as required.

4. Officials and public employees notify the official receipt or request for amendment, supplement to the dossier to the organization or individual no later than eight working hours from the time the system receives the dossier.

5. Information and dossier components mentioned in Clause 2 of this Article, once received and acknowledged for accuracy by the competent authority, will be stored in the electronic data management repository of the organization or individual, provided that the organization or individual consents.
