On January 24, 2025, the Minister of Construction of Vietnam issued Decision 101/QD-BXD regarding the drafting and issuance regulations of legislative documents within the scope of the State management function of the Ministry of Construction.

Guidelines for publishing, reporting, and disseminating legislative documents of the Ministry of Construction of Vietnam

The posting, updating, and reporting, disseminating of legislative documents of the Ministry of Construction of Vietnam is carried out in accordance with the provisions of Article 41 of the regulations issued with Decision 101/QD-BXD in 2025 as follows:

- The Legal Department is responsible for updating legislative documents and consolidated documents according to the regulations of the Government of Vietnam on the national legal database; the drafting unit is responsible for providing information to construct Press Releases about legislative documents issued by the Government of Vietnam, the Prime Minister of the Government of Vietnam in accordance with the legal provisions on press releases about legislative documents.

- Time limit for providing documents for updating:

+ Within 05 working days from the date of publication or signing for issuance for legislative documents, from the date of signing for authentication for consolidated documents, the drafting unit is responsible for sending a PDF copy with a red stamp or an electronic digital signature and an electronic document in ".doc" or ".docx" format to the address of the Document Office of the Legal Department on the Document Management and Operation System to perform the document update;

+ For legislative documents regulating implementation measures in emergency situations, documents issued to promptly meet the requirements of preventing and combating natural disasters, epidemics, according to the legal provisions on issuance of legislative documents and documents effective from the date of publication or signing for issuance, the drafting unit must send to the address of the Document Office of the Legal Department on the Document Management and Operation System on the day of publication or signing for issuance for the Legal Department to perform the document update.

- Time limit for posting documents, sending information for Press Release construction:

+ Within 15 days from the date the document is signed for issuance, the Legal Department is responsible for posting the document on the National Legal Database; the Information Center is responsible for posting the document on the Ministry of Construction's electronic information portal, except for documents containing state secrets.

+ No later than the 5th of the following month, the drafting unit is responsible for providing information about the legislative document in its field of management issued by the Government of Vietnam, the Prime Minister of the Government of Vietnam during the month according to the form specified in Circular 07/2021/TT-BTP of the Minister of Justice regulating press releases about legislative documents issued by the Government of Vietnam, the Prime Minister of the Government of Vietnam (sending paper and electronic copies) to the Ministry of Justice for synthesis, at the same time, sending to the Legal Department for monitoring.

The information content clearly states: the document name, date, month, year of issuance; issuing agency; effective date; necessity, purpose of issuance; main content of the legislative document.

The Legal Department is responsible for monitoring and urging the provision of information to construct the Press Release.
