Guidelines for Public Employees on Salary Transition from Intermediate, College to University Level

Ms. Hoang Thi L sent a question to the Legal Secretary as follows: Currently, I am a tenured teacher and was initially hired with a salary corresponding to an intermediate diploma. During my employment, I have furthered my education by obtaining a university degree. Now, I would like to receive a salary corresponding to my university degree. What is the procedure for salary adjustment? I request the Legal Secretary to advise me.

TEACHERS' SALARY TABLE FROM JULY 1, 2020

Regarding this issue, THU KY LUAT would like to clarify as follows:

Firstly, to be eligible for salary adjustment to a university level, you must first meet the conditions for rank promotion as stipulated in Article 9 of Circular 12/2012/TT-BNV on job titles and changes of job titles for public employees, specifically:

Article 9. Standards and conditions for registering for exams or considering rank promotion for job titles

Public employees can register for exams or consideration for rank promotion when meeting the following standards and conditions:

1. The public service provider has a demand;

2. Successfully performed duties in the most recent 03 continuous years; has good moral character and professional ethics; not during a disciplinary period or notification of disciplinary consideration by the competent authority;

3. Possess sufficient educational qualifications, training, and professional capacity appropriate to the higher rank within the same industry or field;

4. Meet other requirements stipulated by the managing ministry of the specialized public employees.

Currently, the Ministry of Education and Training has no additional requirements, so to be eligible for the initial salary grade transfer, educational public employees need to meet 03 conditions:

  1. The school has a demand;
  2. Successfully performed duties in the most recent 03 continuous years; has good professional ethics; not under disciplinary action or under notification of disciplinary consideration.
  3. Possess sufficient educational qualifications and professional capacity appropriate to the higher rank within the same field (in this case, having a university degree and relevant certificates).

Secondly, be nominated for the exam or consideration for rank promotion

According to the provisions of Article 11 Circular 12/2012/TT-BNV, based on the guidelines for organizing exams or consideration for job title promotion, public service providers compile a list and dossier of public employees meeting the standards and conditions to be sent to the competent authority for examination or consideration. The competent authority will then compile, review, and create the final list.

Thus, to be promoted, a public employee who meets the conditions must be included in the nominee list by the competent authority to participate in the exam/consideration for rank promotion.

Thirdly, must pass the rank promotion examination.

When participating in the rank promotion exam/consideration, the public employee must meet the required results to be eligible for salary adjustment. The criteria for determining the eligible candidate are stipulated in Article 14 of Circular 12/2012/TT-BNV, amended and supplemented in Article 2 of Circular 03/2019/TT-BNV, as follows:

1. A public employee who passes the rank promotion examination must take all required tests, except for those exempted by law; achieve at least 50 points for each test scored on a scale of 100.

2. Public employees who pass the rank promotion consideration shall follow the guidelines of the managing ministry, which stipulates the content and form of consideration for rank promotion for public employees.

In summary, after completing self-study and improving qualifications, having a university degree does not automatically entitle one to a salary adjustment. One must meet the conditions to participate in the exam or rank promotion consideration and pass to be eligible for salary adjustment.
