From August 01, 2024, the market in Vietnam will be categorized into three types according to Decree 60/2024/ND-CP.

On June 5, 2024, the Government of Vietnam promulgated Decree 60/2024/ND-CP concerning the development and management of markets.

From August 1, 2024, markets will be classified as follows:

(1) Classification according to business methods:

- Wholesale markets are markets functioning as provided for in Clause 3, Article 3 of Decree 60/2024/ND-CP and meeting the following criteria:

Scale (area): Minimum floor area of the ground of the market is 10,000 m², excluding the area for campus, roads, parking lots, and other auxiliary structures.

Location: Connected to various types of transport, facilitating goods circulation. The project components include:

Essential structures: parking lots, water supply, drainage, and wastewater treatment systems, waste collection points, restrooms, warehouses, and loading zones;

Technical requirement components: fire prevention and fighting, food safety, and environmental protection, response to climate change as stipulated by law;

Main area components: goods trading areas classified by sector (including wholesale and retail areas); office headquarters; inspection, control, quarantine areas (for goods of animal and plant origin for export, import), traceability and quality management; classification and preliminary processing areas, packaging, warehouse logistics; essential support services and goods handling areas for trucks and containers.

For wholesale markets that have been invested in, built, and are operating before the promulgation of this Decree, they will continue to operate according to the investment project.

- Local markets serve the purpose and function stipulated in Clause 4, Article 3 of Decree 60/2024/ND-CP.

(2) Classification according to scale:

- Grade 1 Market:

A market with over 400 business points, built according to the plan;

The market area suits the operational scale; organizes minimum activities such as parking, public sanitation, and other activities.

- Grade 2 Market:

A market with 200 to 400 business points, built partly or wholly according to the plan;

The market area suits the operational scale; organizes minimum activities such as parking, public sanitation, and other activities.

- Grade 3 Market:

A market with fewer than 200 business points or not yet built, partly or wholly;

The market area suits the operational scale; organizes minimum activities such as public sanitation.

(3) Classification according to capital source:

- Markets invested from state budget:

Construction, management, and business activities at the market shall follow the provisions of Chapter II, Chapter III Decree 60/2024/ND-CP and related legal regulations;

Management, use, and exploitation of state-invested market infrastructure assets shall follow the provisions of Chapter IV Decree 60/2024/ND-CP.

- Markets invested from non-state budget sources (including other legitimate sources as stipulated by law):

Construction, management, and business activities at the market shall follow the provisions of Chapter II, Chapter III Decree 60/2024/ND-CP and other related legal regulations.

More details can be found in Decree 60/2024/ND-CP effective from August 1, 2024.

Markets built before the effective date of Decree 60/2024/ND-CP, that cannot be renovated or upgraded to meet classification criteria, will be classified according to the number of existing business points with respective areas defined at the time of construction and must meet basic requirements for fire prevention, sanitation, and food safety.
