The following article pertains to the management of quality of imported construction material goods in Vietnam from December 16, 2024 stipulated in Circular 10/2024/TT-BXD.

On November 1, 2024, the Minister of Construction of Vietnam issued Circular 10/2024/TT-BXD on the management of the quality of construction material products and goods.

According to the provisions in Article 8 Circular 10/2024/TT-BXD, the quality management of imported construction materials shall be implemented as follows:

The management of the quality of imported construction materials is performed according to Section 4, Chapter III of the Product and Goods Quality Law 2007 and Section 2, Chapter II of Decree 132/2008/ND-CP (amended Clause 3, Article 1 of Decree 74/2018/ND-CP and Clause 3, Article 10 of Decree 09/2021/ND-CP).

- For group 2 construction materials, importers must:

+ Register for state inspection of the quality of imported construction materials at the Department of Construction in one of the localities (Quality Inspection Agency for construction material products and goods, hereinafter referred to as the Inspection Agency):

++  Where  the  enterprise  is  registered  for  business  (or  where  the  representative  office,  branch,  manufacturing  plant  is  located);

++  Where  the  port  of  entry  is  where  the  enterprise  imports  goods;

++  Where  the  enterprise  carries  out  customs  procedures  for  goods  shipments.

+ When registering for state inspection, it is necessary to determine the names of the Certification Organization for Certificate of Conformity, the names of Testing Organizations conducting testing, and quality assessment of imported goods on the Registration Form according to Form No. 01 issued with Decree 74/2018/ND-CP, revised, supplemented according to Clause 9, Article 4 of Decree 154/2018/ND-CP, and must include the following documents: Copy of Contract, List of goods (if any); Copy (certified by the importer) of the bill of lading, invoice, import declaration (if any); Certificate of quality from the exporting country (certificate of quality, test results) (if any); certificate of origin (if any), photos or descriptions of goods with mandatory content to be shown on the goods label and additional label (if the main label does not have enough content as required); Free Sale Certificate CFS (if any).

Form No. 01

- For imported construction materials subject to state quality inspection before customs clearance: The importer shall follow point 2c clause 3 Article 1 of Decree 74/2018/ND-CP, submit a certified copy (signed and stamped by the importer) of the Certificate of Conformity and the Notice of Quality Inspection Results of the imported goods from the Inspection Agency to the Customs Agency for goods clearance permission.

- For imported construction materials subject to state quality inspection after customs clearance: The importer shall follow point 2b clause 3 Article 1 of Decree 74/2018/ND-CP, submit the registration form certified by the Inspection Agency to the Customs Agency for goods clearance permission.

Within 15 working days (for cement products, additives for cement, concrete, and mortar is 35 days) from the date of customs clearance, the importer must submit a certified copy (signed and stamped by the importer) of the Certificate of Conformity and the quality inspection results (conducted by the organization for conformity certification and testing organization named in the registration form) to the Inspection Agency.

+ If the construction materials have already been evaluated by a certification organization in the exporting country, within 3 working days from the date of customs clearance, the importer must submit a certified copy (signed and stamped by the importer) of the Certificate of Conformity to the Inspection Agency.

+ If the importer registers for quality inspection of construction materials on the National Single Window Portal, the registration and quality inspection results are processed through the National Single Window Portal.

- For group 2 construction materials, the Inspection Agency applies pre-clearance or post-clearance inspection measures according to Appendix II of Circular 10/2024/TT-BXD. For pre-clearance inspections, state inspection is based on the certification results of the designated certification organization. For post-clearance inspections, state inspection is based on the certification results of a registered or legally recognized certification organization.

- Implement quality inspection exemption and reduction measures for imported construction materials according to Clause 3, Article 1 of Decree 74/2018/ND-CP and Clause 3, Article 4 of Decree 154/2018/ND-CP.

- Regulations on handling import dossier and quality of imported construction materials not conforming to technical standards are implemented according to Clause 3, Article 6, Article 9 of Circular 06/2020/TT-BKHCN.
