Guidelines for filling the leave certificate to enjoy social insurance in Vietnam 2023 (Internet image)

Circular 18/2022/TT-BYT issued by the Minister of Health of Vietnam on December 31, 2022 amending Circular 56/2017/TT-BYT detailing the Law on Social Insurance and the Law on Occupational Safety and Hygiene in the health sector.

Thus, the instructions for recording the content of the certificate of leave of absence enjoying social insurance in 2023 are as follows:

1. Forms of issuance of certificates of leave to enjoy social insurance in Vietnam

In Clauses 1 and 2, Article 21 of Circular 56/2017/TT-BYT as amended by Circular 18/2022/TT-BYT, the regulations on the form of granting a certificate of leave for social insurance and how to write the contents of a certificate of leave of absence enjoying social insurance are as follows:

- For employees or children under 07 years old of employees who have received inpatient treatment:

Hospital discharge paper according to the form specified in Appendix 3 of Circular 56/2017/TT-BYT.

- In case of a hospital transfer during the course of treatment, a valid copy of the transfer paper is required.

- In case a patient dies at a medical examination and treatment facility, a hospital discharge certificate is not required.

The implementation of the social insurance regime for the period of time when the patient is treated at a medical examination and treatment facility before death is based on the time recorded on the death notice as prescribed in Circular 24/2020/TT-BYT on the diagnosis of the cause of death, the issuance of the death notice, and the death statistics at the medical examination and treatment facility.

- In the event that the employee or the employee's children under the age of seven are receiving outpatient treatment:

Certificate of leave of absence enjoying social insurance according to the form specified in Appendix 7 of Circular 56/2017/TT-BYT.

In case the patient needs to take leave for outpatient treatment after being discharged from the hospital, the social insurance agency shall use the number of days off stated in the notes section of the discharge paper as a basis for payment under the social insurance regime, according to regulations. determined.

2. Guidelines for filling the leave certificate to enjoy social insurance in Vietnam

Circular 56/2017/TT-BYT provides guidelines for filling the leave certificate to enjoy social insurance in Clause 3, Clause 4, and Article 21 as follows:

The form and method of recording the certificate of leave for social insurance shall comply with the provisions in Appendix 7 of Circular 56/2017/TT-BYT.

- The recording of the start date of leave beginning on the day the patient arrives for a medical examination and treatment;

- The recording of the date in the day, month and year entries on the practitioner's signature on the certificate of leave for social insurance benefits is as follows:

+ Record the date and month when the patient finishes the medical examination and treatment;

+ The date on which the medical examination and treatment establishment issues the certificate of leave for social insurance in the event that the employee requests re-issuance in accordance with the provisions of this Circular;

- If the certificate of leave to enjoy social insurance is re-issued, the word "RE-ISSUE" must appear on it.

- The recording of the disease code, the name of the long-term disease on the certificate of leave for social insurance, the hospital discharge certificate must comply with the provisions of Circular 46/2016/TT-BYT on promulgating the list of diseases requiring long-term treatment. 

In case the disease code stated in the certificate of leave for social insurance benefits, the hospital discharge certificate matches the disease code specified in Circular 46/2016/TT-BYT, but the name of the disease does not match the name of the patient according to Circular 46/2016/TT-BYT, then:

Carry out treatment of long-term diseases according to the disease code specified in Circular 46/2016/TT-BYT.

Circular 18/2022/TT-BYT takes effect from February 15, 2022.
