This content is stipulated in Circular 08/2017/TT-BTP issued by the Ministry of Justice on November 15, 2017, guiding the Law on Legal Aid and the documentation in legal aid activities.
Circular 08 stipulates that within 15 days from the expiring date of the application submission, the Lawyer Assessment Committee must complete the evaluation. If necessary, the evaluation time can be extended, but not exceeding 5 working days.
The evaluation is conducted in two steps, including:
- Step 1: Evaluate the validity of the application. Use the criteria of meeting or not meeting the requirements for evaluation. Applications that are complete and submitted on time are evaluated as meeting the requirements and will continue to be evaluated in step 2.- Step 2: Evaluate the level of meeting the need for legal assistance. Use a scoring method on a scale of 100 points for evaluation, in which the minimum and maximum points for each criterion are specified. The final score is the average score of the members of the Lawyer Assessment Committee and is ranked in descending order. In case there are two or more lawyers with the same score, the Head of the Lawyer Assessment Committee decides.
Simultaneously, Circular 08 also stipulates that the Head of the Lawyer Assessment Committee is responsible for compiling the evaluation results of the members and ranking them in descending order according to the score obtained. The evaluation results summary table must have the signatures of the members.
Note that the center is responsible for notifying the selection results to the lawyers who submitted the applications. Lawyers must have a final evaluation score of 50 points or more and be selected in descending order until the projected number of selections is reached.
Within 10 days from the notification date, the selected lawyer is responsible for signing a contract with the Center. If the selected lawyer does not sign the contract by the deadline, the Center will notify and sign the contract with the lawyer who has the next highest score (if any).
