Guidelines for constructing and implementing standards, regulations, and technical specifications for data connection and sharing.

On March 22, 2024, the Ministry of Information and Communications issued Official Dispatch 1016/BTTTT-CDSQG, providing guidelines for constructing and implementing standards, regulations, and technical specifications for data connection and sharing.

(1) Forms of technical regulations regarding data

Depending on the specific cases and practical needs, agencies and organizations are responsible for constructing standards, regulations, and technical specifications (referred to collectively as technical regulations) to select and build data regulations for application in connection with and data sharing according to their authority. The following forms of issuance are available:

- Technical standards: technical documents issued in accordance with the Law on Standards and Technical Regulations, serving as references for optional applications. National standards are constructed and proposed for appraisal and publication by the Ministry of Science and Technology, organized by ministries, government agencies, and organizations for use in their activities. Some technical standards are accepted by international technical standards.

If a technical standard has already been issued and referenced, and is mandatory in legal documents, it has equivalent application value to technical regulations.

For this form, priority is given to the issuance of standards and technical specifications accepted from international standards for use in Vietnam or technical regulations regarding widely-used data with multiple levels, relatively standardized and stable in application.

- Technical regulations: technical documents issued in accordance with the Law on Standards and Technical Regulations that are mandatory. National technical regulations are constructed and issued by ministries and government agencies within their assigned management scope. Local technical regulations are constructed and issued by provincial people's committees and centrally-controlled cities within their management scope.

For this form, priority is given to the selection of regulations regarding data structure in national databases and specialized data shared among state agencies.

- Other technical regulations: legal documents in the form of Circulars or Decisions by competent authorities that regulate the application of already issued technical standards or define specific technical criteria and characteristics for implementing information systems, databases, or activities related to the construction, updating, maintenance, exploitation, sharing, and use of data.

This form is chosen for the issuance and application of specific data sharing and usage cases of an information system or database, or in cases where conditions for constructing and issuing standards and technical regulations are not yet met.

(2) Types of technical regulations regarding data:

The current application of technical regulations regarding data focuses on two main types: basic technical regulations on data-related technologies and technical regulations on data structure.

- Basic technical regulations on data-related technologies are constructed and issued by the Ministry of Information and Communications based on research, reference to international data standards, and general regulations applied in the field to ensure compatibility and synchronization in the implementation, construction, updating, maintenance, exploitation, sharing, and use of data.

Currently, the Ministry of Information and Communications has issued a list of basic technical standards on data-related technologies in Circular 39/2017/TT-BTTTT dated December 15, 2017, which specifies the list of technical standards on information technology applications in state agencies

(The basic standards on data-related technologies are quoted and further instructed in Appendix II).

Other technical regulations are coordinated by the Ministry of Information and Communications with relevant agencies for construction and application guidance in documents compiled in Section 4 of Official Dispatch 1016/BTTTT-CDSQG dated March 22, 2024, to facilitate the application by agencies and organizations.

- Technical regulations on data structure describe the content, meaning, and usage of data and are constructed, exchanged, and exploited by ministries, sectors managing relevant data, or state agencies responsible for managing databases.

The implementation categories for constructing, storing, connecting, and sharing data must comply with the corresponding standards, regulations, and technical specifications on data structure.
