According to Article 6 of Circular 29/2024/TT-BGDDT, the requirements for extra classes outside of schools are as follows:
- Organizations or individuals conducting extra classes activities for a fee (hereinafter referred to as tutoring centers) must comply with the following requirements:
+ Register a business according to legal provisions;
+ Publicly disclose on the electronic portal or post at the tutoring center's headquarters the subjects offered for extra classes; the duration for each subject by grade level; the location, format, and schedule of extra classes sessions; the list of teachers and the tuition fees before enrolling students into extra classes (as per Form No. 02 in the Annex attached to Circular 29/2024/TT-BGDDT).
- Tutors outside of schools must ensure they have good moral character and suitable professional competence for the subjects they teach.
- Teachers currently teaching at schools who wish to tutor outside must report to the Principal or Director or head of the school (hereinafter referred to as the Principal) about the subject, location, format, and schedule for tutoring (as per Form No. 03 in the Annex attached to Circular 29/2024/TT-BGDDT).
As stated in section 1, teachers opening extra classes for a fee must register a business.
The business registration for extra classes can be done under one of the following business types: Household business, sole proprietorship, partnership, limited liability company, or joint stock company.
For teachers registering a extra classes business outside of schools, the household business model is appropriate.
Teachers opening extra classes should register their business following the procedures below:
- Household business registration is conducted at the district-level Business Registration Office where the household business's headquarters is located.
- The application dossier for household business registration includes:
+ Business registration application form for household business;
+ Personal legal documents of the householder, and family members registering the household business if applicable;
+ A copy of the minutes of the family meeting on establishing a household business if applicable;
+ A copy of the document authorizing one family member to act as the householder if applicable.
- Upon receiving the application, the district-level Business Registration Office issues a Receipt and grants a Certificate of Household Business Registration within 03 working days from the date of receiving a valid application.
If the application is invalid, within 03 working days from receiving the application, the district-level Business Registration Office must notify the applicant in writing, stating the reasons and requirements for amending or supplementing the application (if any).
- If after 03 working days from the date of submission, the applicant does not receive the Certificate of Household Business Registration or a notification requesting amendments or supplements, the business applicant or household business has the right to complain or denounce according to legal provisions on complaints and denunciations.
- Periodically, in the first working week of each month, the district-level Business Registration Office sends a list of registered household businesses from the previous month to the same level Tax Office, Business Registration Division, and provincial-level specialized management agencies.
