On July 31, 2024, the Minister of Construction of Vietnam issued Circular 05/2024/TT-BXD detailing certain provisions of the Housing Law 2023.

Guidelines for apartment building maintenance in Vietnam from August 1, 2024

Pursuant to Article 32 of the Regulations issued with Circular 05/2024/TT-BXD, the guidelines for maintaining apartment buildings in Vietnam are as follows:

- Maintenance activities of the common property areas of the apartment building include inspection, monitoring, quality assessment, minor repairs, periodic repairs, and major repairs of the building structure, inspection and maintenance of fire safety systems and other common property areas of the apartment building, replacement of components or shared equipment of the building or apartment building complex, and other maintenance activities as specified under construction law.

- Owners of apartment building units are responsible for maintaining their exclusive property areas and contributing to the costs to maintain the common property areas of the apartment building as stipulated in the Housing Law 2023 and the Regulations issued with Circular 05/2024/TT-BXD.

In case the exclusive property area is damaged, affecting other owners, the owner is responsible for repairing such damages. If the owner does not conduct repairs, the management unit or the property manager has the right to temporarily suspend or request the service providers to temporarily suspend the supply of electricity and water services to the exclusive property area. If the common property areas within the exclusive property area are damaged, the exclusive property owner is responsible for facilitating and assisting the apartment building management unit and the repair unit in repairing these damages.

- Maintenance of the apartment building building structure must be carried out by qualified units as per construction law. Maintenance of the apartment building's equipment systems must be performed by units qualified for the maintenance work. If the apartment building management unit is qualified for maintenance, it may be contracted to perform the maintenance.

- Until the first apartment building Meeting is held, maintenance of the common property areas of the apartment building follows the maintenance plan prescribed in Clause 3, Article 33 of the Regulations issued with Circular 05/2024/TT-BXD.

- After the first apartment building Meeting, maintenance of the common property areas in multi-owner apartment buildings must follow the maintenance plan prescribed in Clause 3, Article 33 of the Regulations issued with Circular 05/2024/TT-BXD and the annual maintenance plan approved by the apartment building Meeting as per the Regulations issued with Circular 05/2024/TT-BXD. In the event of sudden damages or damages due to natural disasters or fires, the apartment building Management Board decides on the maintenance in accordance with the Regulations issued with Circular 05/2024/TT-BXD and relevant laws but must report to the apartment building Meeting at the nearest meeting.

- Maintenance of the common property areas of the apartment building is performed according to the provisions at Section 4, Chapter III of the Regulations issued with Circular 05/2024/TT-BXD.

Refer to Circular 05/2024/TT-BXD which comes into effect in Vietnam from August 1, 2024.
