Guideline for Implementing the Development of Draft QCVN under the Authority of the Ministry of Information and Communications

Circular 13/2019/TT-BTTTT stipulates that the assigned leading unit (hereinafter referred to as the leading unit) shall implement the development of the draft National Technical Regulation in the field of information and communication (hereinafter referred to as QCVN) following the following procedures and requirements:

- Organize research and develop the QCVN draft according to the content, schedule, and approved QCVN development project.- Organize conferences, workshops, and collect opinions from experts and relevant organizations and individuals.- Report to the Ministry of Information and Communications (Department of Science and Technology) when there are changes in the content and schedule of the QCVN and report the implementation contents upon request.- Report to the Ministry of Information and Communications (Department of Science and Technology) to send the QCVN draft for broad consultation from relevant agencies, organizations, and individuals; and collect opinions on the portals of the Government of Vietnam and the Ministry of Information and Communications for at least 60 (sixty) days. In cases where the QCVN can create technical barriers to international trade, the QCVN draft must be sent for international consultation according to the provisions of international treaties to which Vietnam is a signatory or participant.- Based on the feedback from relevant agencies, organizations, and individuals, complete the QCVN draft and the QCVN draft dossier to be sent to the Ministry of Information and Communications for verification. The QCVN draft dossier includes:

- Official Dispatch requesting the verification of the QCVN draft dossier of the leading unit sent to the Ministry of Information and Communications (Department of Science and Technology);- Decision approving the QCVN development plan;- Approved QCVN development project as per the form in Appendix II of this Circular;- Report on the process of developing the QCVN draft;- Explanation of the QCVN draft (including electronic copy) as per the form in Appendix VI of this Circular;- QCVN draft (including an electronic copy) attached with copies of original documents used as the basis for developing the QCVN draft and other reference materials (if any);- List of agencies, organizations, and individuals sent the QCVN draft for comments; explanatory report and responses to the comments attached with the written feedback;- Other documents and materials (if any).

- Coordinate with the Department of Science and Technology to complete the QCVN draft dossier during the appraisal and issuance of QCVN.
