October 23, 2024, the Government of Vietnam issued Decree 137/2024/ND-CP regulating electronic transactions of State agencies and information systems serving electronic transactions in Vietnam.

According to the provisions of Article 6 of Decree 137/2024/ND-CP on transferring the operations of State agencies to the electronic environment in Vietnam

- State agencies prioritize full-process implementation in the electronic environment for activities including: public service provision; internal administration; direction, management; monitoring, inspection, auditing according to an appropriate roadmap and plan.

In cases where activities involve state secrets, compliance with laws on protecting state secrets and cryptographic laws must be ensured.

- Develop an information technology application plan, digital transition serving the activities of State agencies in the electronic environment

+ Ministries, ministerial-level agencies, agencies under the Government of Vietnam (hereinafter referred to as ministries and central authorities), People's Committees of provinces and centrally-controlled cities (hereinafter referred to as provincial People's Committees) have the responsibility to develop, approve, and implement a 5-year, annual plan on information technology application, digital transition; this must include goals, tasks, and solutions to guide State agency operations towards full-process implementation in the electronic environment, at a minimum including activity areas: public service provision; internal administration; direction, management; monitoring, inspection, auditing;

+ The Ministry of Information and Communications is responsible for guiding ministries, central authorities, and the People's Committees of provinces to develop a 5-year, annual plan on information technology application, digital transition.

- The basic requirements for information systems, digital platforms serving the activities of State agencies in the electronic environment:

+ Ensure suitability with the Vietnamese Electronic Government Architecture Framework and the Government of Vietnam's Architecture Framework at the ministry and provincial levels;

+ Ensure integration, interoperability, sharing, usage, and reuse of information, data;

+ Ensure authenticity, reliability, integrity, and ease of access, continuity, stability for usage;

+ Allow for checking, verifying information, data to serve reporting tasks, inter-agency interoperability, and meet other requests of agencies, organizations, individuals as authorized when required;

+ Ensure the ability to develop, upgrade, expand according to practical needs;

+ Ensure compliance with legal requirements on network information safety, cybersecurity;

+ Ensure other requirements according to relevant legal regulations.

- The deployment of information systems, digital platforms serving the activities of State agencies in the electronic environment must be linked to the public administration reform efforts of State agencies to innovate working methods, direction, management based on data, enhance processing of documents and work files in the electronic environment, increase the efficiency and effectiveness of State agency operations; reduce costs and time for task processing.

More details can be found in Decree 137/2024/ND-CP which comes into force in Vietnam from October 23, 2024.
