This is the content in Official Dispatch 481/BTP-HTQTCT dated February 4, 2025, from the Ministry of Justice regarding the implementation of the provisions of Decree 07/2025/ND-CP.
To be specific, on January 9, 2025, the Government of Vietnam issued Decree 07/2025/ND-CP, amending and supplementing several articles of the Decrees in the field of civil status, nationality, and certification. This Decree takes effect from the date of signing, and the Ministry of Justice has issued a Decision to promulgate the administrative procedures that have been amended and supplemented in the field of civil status, nationality, and certification.
To implement the consistent provisions of Decree 07/2025/ND-CP, the Ministry of Justice requests Provincial and Central City People's Committees to focus on the following:
* Direct the Department of Justice to cooperate with related Departments and sectors to disseminate and thoroughly grasp the content of Decree 07/2025/ND-CP to relevant agencies, organizations, and individuals, with particular attention to a few contents:
- Upon receiving requests for birth registration, the civil status registration agency shall not require presentation of the Marriage Certificate of the child's parents (if the child's parents have registered their marriage, except where the child's parents are foreigners); upon receiving marriage registration requests, the civil status registration agency shall not require submitting the Marriage Status Confirmation, Divorce Note Extract (for Vietnamese citizens) but shall search for information on the marriage status of the child's parents, search for information on the marriage status of the person requesting marriage registration on the Provincial Administrative Procedure Settlement Information System through the connection with the electronic civil status database, the national population database. In case the marriage status cannot be searched due to lack of information in the database, the civil status registration agency shall verify according to point c clause 3 Article 2 of Decree 07/2025/ND-CP.
- Ensure conditions regarding infrastructure, technology, and implementation of connection between the local Administrative Procedure Settlement Information System and the Shared Electronic Civil Status Registration and Management Information System of the Ministry of Justice to receive, handle birth registration, marriage registration, and marriage status confirmation procedures conformably.
- The Department of Justice proactively requests the judicial record database management agency to issue a Judicial Record Certificate for those requesting to apply for reacquisition or renunciation of Vietnamese nationality during their residence in Vietnam to complete the application for acquiring or reacquiring or renouncing Vietnamese nationality, except when the requestor already has a Judicial Record Certificate at the time of application submission.
- The Department of Justice or the Representative Agency, where the requestor resides, at the time of application submission, has the authority to receive and resolve requests for issuing Certificate of Vietnamese Nationality, Certificate of Vietnamese Origin (stipulated in clause 5, clause 7 Article 4 of Decree 07/2025/ND-CP).
- The commune-level People's Committees shall authenticate copies from the original of documents, papers issued by competent foreign authorities; competent Vietnamese authorities linked with competent foreign authorities for issuance or certification (supplemental authority stipulated in clause 1 Article 1 of Decree 07/2025/ND-CP).
* Documents related to authentication, civil status, and nationality received before the Decree takes effect that have not yet been resolved shall continue to be resolved according to the provisions of Decree 23/2015/ND-CP, Decree 123/2015/ND-CP, Decree 87/2020/ND-CP, Decree 16/2020/ND-CP.
