Recently, the Government of Vietnam issued Decree 129/2017/ND-CP on regulations for the management, use, and exploitation of irrigation infrastructure property in Vietnam
Guidance on the documentation for the transfer of irrigation infrastructure property in Vietnam (Illustration)
Decree 129/2017/ND-CP stipulates that when there is irrigation infrastructure property that need to be transferred, the agency assigned to manage the property shall prepare a application for the transfer and report it to the Ministry of Agriculture and Rural Development and the Provincial People's Committee. The application for property transfer in Vietnam includes:
- A written request for property transfer from the agency assigned to manage the property: 01 original copy;
- A written request for property acquisition from the agency, unit receiving the property: 01 original copy;
- A written request for property transfer and acquisition from the Ministry of Agriculture and Rural Development, the Provincial People's Committee in cases where the Prime Minister decides and the Minister of Finance: 01 original copy;
- A list of property proposed for transfer (type, quantity, original cost, remaining value, current usage purpose, and intended usage purpose after transfer in cases where the transfer is associated with a change in the functional use of the property) according to Form No. 06/TSTL-DM issued together with this Decree: 01 original copy;
- Other relevant documents (if any): 01 copy.
Within 30 days from the date of receipt of the complete and valid application for the transfer of irrigation infrastructure property, the competent authority shall decide on the property transfer or provide a written response in the event the property transfer request is not suitable.
