On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating conditions for investment and operation in the field of education in Vietnam.

Guidance on the dissolution of education quality accreditation organizations in Vietnam from November 20, 2024

According to Article 111 of Decree 125/2024/ND-CP, the dissolution of education quality accreditation organizations in Vietnam is as follows:

- An education quality accreditation organization is dissolved in one of the following cases:

+ Serious violation of regulations concerning management, organization, and operation of the education quality accreditation organization as concluded by a competent authority;

+ Six months from the date of establishment decision or permission to establish, the education quality accreditation organization fails to carry out procedures to request permission for educational quality assessment activities or does not meet the conditions for such permission;

+ End of the suspension period for educational quality assessment activities without resolving the causes of the suspension;

+ Expiration of the permit for educational quality assessment activities without requesting an extension or without being granted an extension;

+ At the request of the organization or individual establishing the education quality accreditation organization.

- The Minister of Education and Training decides on dissolving an education quality accreditation organization.

- Documentation:

+ An education quality accreditation organization dissolved as stipulated in point e clause 1 Article 111 Decree 125/2024/ND-CP, the documentation includes:

Submission  proposing  dissolution  of  the  educational  quality  assessment  organization;

Plan  for  handling  regarding  the  organizational  structure,  personnel,  finances,  assets,  land,  and  other  related  issues.

+ An education quality accreditation organization dissolved as stipulated in points a, b, c, and d clause 1 Article 111 Decree 125/2024/ND-CP, the documentation includes:

Submission  proposing  dissolution  of  the  educational  quality  assessment  organization  along  with  evidence  of  violations  leading  to  dissolution;

Plan  for  handling  regarding  the  organizational  structure,  personnel,  finances,  assets,  land,  and  other  related  issues.

- Procedure:

+ For dissolution as stipulated in point e clause 1 Article 111 Decree 125/2024/ND-CP:

Organizations  or  individuals  submit  one  set  of  documentation  as  stipulated  in  point  a  clause  3  Article  111  through  the  online  public  service  portal,  by  post,  or  directly  to  the  Ministry  of  Education  and  Training of Vietnam;

Within  30  days  from  the  date  of  receiving  the  dissolution  recommendation  documentation,  the  Minister  of  Education  and  Training  organizes  verification,  evaluation,  and  decides  on  the  dissolution  of  the  educational  quality  assessment  organization;

+ For dissolution as stipulated in points a, b, c, and d clause 1 Article 111 Decree 125/2024/ND-CP:

The  Minister  of  Education  and  Training  directs  the  preparation  of  dissolution  documentation  in  accordance  with  point  b  clause  3  Article  111  Decree 125/2024/ND-CP,  stating  the  reasons  for  dissolution  and  notifying  the  educational  quality  assessment  organization;

Within  30  days  from  the  date  of  notification  of  documentation  preparation  for  dissolution,  the  Minister  of  Education  and  Training  organizes  verification,  evaluation,  and  decides  on  the  dissolution  of  the  educational  quality  assessment  organization.

- The decision to dissolve the education quality accreditation organization is publicly announced in the mass media.

More details can be found in Decree 125/2024/ND-CP which comes into force in Vietnam from November 20, 2024.
