Guidance on Reporting the Implementation of State Compensation Work in Vietnam

This is a noteworthy regulation mentioned in Circular 08/2019/TT-BTP regarding measures for the implementation of state management functions on state compensation work in Vietnam.

Article 25 of Circular 08/2019/TT-BTP stipulates the annual report on state compensation work, which includes actual data and estimated data for the reporting period. In there:

- Actual data is collected from January 1 to the end of October 31 each year. The Ministry of Justice (Hanoi, Vietnam) must receive the annual report no later than December 8 of the reporting year.

- The estimated data is calculated as follows:

- Estimated data is determined according to the formula:

Estimated data = Total actual data x Number of estimated months
Number of months for actual data collection

Reporting units, when sending reports to the Ministry of Justice (Hanoi, Vietnam), only need to report the actual data for the reporting period, they do not need to report the estimated data. The Department of State Compensation, Ministry of Justice (Hanoi, Vietnam), actively estimates on a nationwide basis.

- Rounding rule for estimated data: In cases where the calculated data has a decimal part of 0.5 or more, round up to the nearest whole number; if the decimal part is less than 0.5, round down to the nearest whole number. Example: The number 3,217.56 is rounded up to 3,218. The number 3,217.35 is rounded down to 3,217.

For the official annual statistical data, it includes all the actual data performed during the reporting period (calculated from January 1 to the end of December 31 each year). The Ministry of Justice (Hanoi, Vietnam) must receive the official annual statistical data no later than January 31 of the following year.

In cases where the deadline for receiving statistical data or reports coincides with a weekend or public holiday as prescribed by law, the deadline will be the next working day after the holiday.
