Guidance on Recording Content in the Application for Innovation Recognition

This notable provision is referenced by the Ministry of Science and Technology in Circular 18/2013/TT-BKHCN guiding the implementation of certain regulations of the Regulation on Initiatives issued under Decree 13/2012/ND-CP (hereinafter referred to as the “Regulation on Initiatives”).

According to the regulations, the author of the initiative must be responsible for the honesty of the information stated in the application for recognition of the initiative. The content of the application for recognition of the initiative under Clause 3, Article 5 of the Initiative Regulations issued under Decree 13/2012/ND-CP (hereinafter referred to as the "Initiative Regulations") is specifically guided in Article 5 of Circular 18/2013/TT-BKHCN as follows:

- Name of the institution requested for recognition of the initiative;- The author of the initiative or co-authors of the initiative (if any) and the contribution ratio of each co-author;- The investor who created the initiative: In case the author of the initiative is not concurrently the investor who created the initiative, the application must clearly state which authority, organization, or individual is the investor who created the initiative. If the initiative was created with State funding, material and technical means, this information must be clearly stated in the application;- Name of the initiative; field of application; description of the nature of the initiative; confidential information (if any):

- Name of the initiative: Must reflect the nature of the solution in the application;

- Field of application: Clearly state the field in which the initiative can be applied and the problem that the initiative solves;

- Description of the initiative:

 + Regarding the content of the initiative: Provide a brief, comprehensive, and clear description of the steps to implement the solution and the necessary conditions to apply the solution; if it is an improvement of a previously known solution at the institution, the application must clearly state the condition of the known solution, the contents that have been improved, and innovations to overcome the disadvantages of the known solution. The description of the content of the initiative may be illustrated by drawings, designs, diagrams, product sample photographs, etc., if necessary; + Regarding the applicability of the initiative: Clearly state whether the solution has been applied, including trial applications under economic and technical conditions at the institution and has yielded practical benefits; additionally, it may state whether the solution is capable of being applied to other entities, agencies, or organizations;

- Confidential information (if any);

- Necessary conditions to apply the initiative;- Participants in organizing the first application of the initiative (if any);- Evaluation of the benefits obtained or expected to be obtained from the application of the solution in the application according to the author's and the entity’s opinions, including trial applications at the institution according to the following contents:

- Compare the economic and social benefits obtained by applying the solution in the application with the case of not applying that solution, or with similar known solutions at the institution (clearly state how the solution brings higher economic efficiency, social benefits, or to what extent it overcomes the disadvantages of previously known solutions if it is an improvement of previously known solutions);

- Profit amount (if calculable) and detailed calculation method.

The application for recognition of the initiative can be made according to the form stipulated in Appendix I issued together with Circular 18/2013/TT-BKHCN, except in cases where the institution where the author submits the application for recognition of the initiative uses a different form.
