Guidance on ranking, salary grade for officials subjected to disciplinary actions of salary reduction, rank reduction in Vietnam

Recently, the Ministry of Home Affairs of Vietnam has issued Circular 03/2006/TT-BNV guiding the implementation of Decree 35/2005/ND-CP on the disciplinary action of officials in Vietnam.

Circular 03/2006/TT-BNV guides the implementation of ranking, salary grade for officials subjected to disciplinary actions of salary reduction and rank demotion in Vietnam as follows:

1. For officials subjected to disciplinary actions of salary reduction, proceed as follows: Any official currently enjoying a salary grade in a given official (or public employee) rank shall be demoted to the immediately lower grade within the same rank. The period until the next salary promotion will be calculated from the time the official held the salary level before committing the disciplinary violation.

2. For officials subjected to disciplinary actions of rank demotion, proceed as follows: Any official currently holding a rank in a given field shall be demoted to the immediately lower rank within the same field and aligned to the closest lower salary coefficient compared to the coefficient held before the discipline was enacted. The period until the next salary promotion will be calculated from the time the official held the salary level before committing the disciplinary violation.

3. Addressing salary promotions for officials subjected to disciplinary actions of salary reduction or rank demotion:

- Officials disciplined with salary reduction or rank demotion will not have their salary promotion period extended by an additional year (12 months); however, during the effective period of the disciplinary decision, no seniority-based salary promotion shall be addressed. Following the end of the disciplinary decision’s effective period, salary promotions based on seniority will be considered.

- For officials disciplined with salary reduction or rank demotion, the period for consideration of the next salary promotion will start from the time the official held the salary grade prior to the disciplinary action.
