On November 09, 2024, the Government of Vietnam promulgated Decree 147/2024/ND-CP on the management, provision, and use of Internet services and information on networks.

Guidance on providing information content services on mobile telecommunications networks in Vietnam from December 25, 2024

According to the provisions of Article 70 of Decree 147/2024/ND-CP, the provision of information content services on mobile telecommunications networks is as follows:

- Providing information content services on mobile telecommunications networks involves organizations or enterprises setting up equipment systems in Vietnam to connect to mobile telecommunications networks to provide information content to mobile telecommunications service users associated with messaging services, voice services (premium call services, free call services, information response services), and Internet access services on mobile telecommunications networks.

Registration for connection to provide information content services on mobile telecommunications networks involves organizations or enterprises reporting to the competent authority with details about the organization or enterprise, the type of information content service provided, the service delivery method, and a commitment to meet conditions for providing information content services on mobile telecommunications networks.

- Organizations or enterprises providing information content services on mobile telecommunications networks must conduct payments following the provisions in Clause 3, Article 61 of the Telecommunications Law 2023 and must have a Registration Certificate to provide information content services on mobile telecommunications networks and ensure compliance with the legal provisions in Decree 147/2024/ND-CP for the specialized content services they provide.

For free call services and premium call services, it is not necessary to undergo the connection registration procedure to provide information content services on mobile telecommunications networks.

For information content services provided to mobile telecommunications service users associated with Internet access services on mobile telecommunications networks, organizations or enterprises must have a License, Certificate, or Specialized Confirmation issued by the Ministry of Information and Communications or the Department of Information and Communications.

- Conditions for granting a Connection Registration Certificate to provide information content services on mobile telecommunications networks:

+ Be an organization or enterprise established under the laws of Vietnam with functions, tasks, or registered business areas for providing information content services on mobile telecommunications networks, posted on the National Business Registration Portal;

+ Ensure information content aligns with the regulations in Clause 43, Article 3 and Clause 2, Article 70 of Decree 147/2024/ND-CP; have a service provision plan and commitment to fulfill all responsibilities of an organization or enterprise providing information content services on mobile telecommunications networks as stipulated in Article 74 of Decree 147/2024/ND-CP.

Refer to Decree 147/2024/ND-CP effective from December 25, 2024.

The following regulations are repealed:

- Decree 72/2013/ND-CP of the Government of Vietnam regarding the management, provision, and use of Internet services and information on networks;

- Decree 27/2018/ND-CP of the Government of Vietnam amending and supplementing a number of articles of Decree 72/2013/ND-CP of the Government of Vietnam regarding the management, provision, and use of Internet services and information on networks;

- Article 2 of Decree 150/2018/ND-CP of the Government of Vietnam amending several decrees related to business investment conditions and administrative procedures in the field of information and communications.
