Guidance on Preparing the Report Dossier for the Term Congress of the Association

This is a notable regulation specified in Circular 03/2013/TT-BNV, issued by the Ministry of Home Affairs, detailing the implementation of Decree 45/2010/ND-CP on the organization, operations, and management of associations, as well as Decree 33/2012/ND-CP amending and supplementing several provisions of Decree 45/2010/ND-CP.

According to the provisions of Article 2 of Circular 03/2013/TT-BNV, the documentation for reporting the organization of the association’s term congress includes the following documents:

- Resolution of the association’s leadership board on organizing the term congress;- Draft report summarizing the term’s work and the direction for activities in the upcoming term of the association. Self-assessment reports of the leadership board, the inspection committee, and the financial report of the association;- Draft of amended and supplemented charter (if any);- Proposed list of personnel for the leadership board, inspection committee, clearly stating the standards, structure, and number of members of the leadership board and inspection committee of the association. For proposed personnel as the head of the association, follow the provisions of Clause 2, Article 8 of this Circular;- Planned time and place for organizing the congress, the number of invited delegates, official delegates attending the congress, and the planned program of the congress;- Report on the number of association members, clearly stating the number of official members of the association;- Other contents under the congress's authority according to the association's charter and legal regulations (if any).- Regarding the documentation for reporting extraordinary congresses, it includes:- Resolution of the association’s leadership board on organizing the extraordinary congress, clearly stating the contents to be discussed and decided at the congress;- Draft of the contents to be discussed and decided at the congress;- Planned time and place for organizing the congress, the number of invited delegates, official delegates attending the congress, and the planned program of the congress.

Within fifteen days from the date of receiving complete and lawful reporting documentation, the competent state authority specified in Article 14 of Decree 45/2010/ND-CP must provide written comments on the organization of the congress. In cases where it is necessary to seek opinions from agencies related to the main sector or field in which the association operates, a written opinion on the organization of the congress must be provided no later than twenty-five days.

The association organizes a term congress or an extraordinary congress after receiving a written opinion from the competent state authority specified in Article 14 of Decree 45/2010/ND-CP.

Note that if the association organizes a congress without reporting according to regulations, the competent state authority specified in Article 14 of Decree 45/2010/ND-CP will not approve the charter passed by the congress.
