Guidance on preparation of establishment scheme of an administrative unit in Vietnam

Recently, the Government of Vietnam issued Decree No. 158/2018/NĐ-CP prescribing establishment, restructuring and dissolution of administrative units.

According to Decree No. 158/2018/NĐ-CP of Vietnam’s Government, contents of the establishment scheme of an administrative unit include:

- The necessity and legal grounds for establishing the administrative unit;

- Objectives, management scope and entities;

- Form and name of the administrative unit;

- Position, functions, tasks, powers and organizational structure;

- Reports on fulfillment of establishment criteria as prescribed by law;

- Estimated working positions and payroll of officials according to scale-based working positions and structure of officials which must be conformable with its functions, tasks and powers; information about its working office and equipment and financial mechanism for ensuring its operation;

- Establishment plan and roadmap for operation of the administrative unit;

- Suggestions of the agency or organization preparing the establishment scheme (if any);

- Other contents as prescribed by the specialized law and guidelines given by the supervisory ministry.
