Recently, the Minister of Public Security has signed to promulgate Circular 47/2014/TT-BCA specifying the detailed implementation of certain articles of Decree 115/2013/ND-CP on the management and preservation of administrative violation exhibits and means that are temporarily held or confiscated according to administrative procedures.

From December 7, 2014, onwards, the deposit guarantee for temporarily seized vehicles under administrative procedures shall be carried out in accordance with the provisions of Article 15 of Decree 115/2013/ND-CP and the following regulations:

- The violating organization or individual must submit a request to the competent authority that is holding the vehicle for the purpose of self-preservation and maintenance of the vehicle.- The time limit for considering and deciding on handing over the vehicle to the violating organization or individual for self-preservation and maintenance, as well as the responsibility for managing and maintaining the vehicle during the consideration and decision process, shall be implemented in accordance with Point b, Clause 1 and Clause 2, Article 7 of Circular 47/2014/TT-BCA.- If the violating organization or individual, after placing a deposit guarantee, uses the vehicle or allows another organization or individual to use the vehicle for illegal racing, resisting law enforcement officers, causing public disorder, causing traffic accidents, or using the vehicle for other illegal activities, the vehicle shall be returned to the detention place as provided by the regulations.- …
