On July 29, 2024, the Government of Vietnam issued Decree 101/2024/ND-CP regulating basic land investigation; registration, issuance of land use rights certificates, property ownership certificates associated with land, and the Land Information System.

Guidance on measuring, making cadastral maps in Vietnam from August 1, 2024

Under Article 5 of Decree 101/2024/ND-CP, for measuring, making cadastral maps activities requiring technical design - estimation, and task plans, the implementation is as follows:

- Review and determine the areas needing cadastral maps: The provincial land management authority shall organize the review of measuring, making cadastral maps products in the area, determine, and summarize the needs for measuring, making cadastral maps to report to the provincial People's Committee to decide the areas and scope requiring measuring, making cadastral maps.

For areas conducting cadastral map extraction measurements, the land management authority shall approve and allow implementation concurrently with the appraisal process of the task plan proposed by the project investor as prescribed in Clause 3, Article 5 of Decree 101/2024/ND-CP.

- Survey, prepare technical design - estimation, and task plans: The agency or unit assigned the task or appointed as the project investor (hereinafter referred to as the project task owner) is responsible for organizing the survey of the measuring, making cadastral maps area, preparing, submitting for approval the technical design - estimation, and task plans; the project task owner is allowed to select a consultancy unit to prepare the technical design - estimation, and task plans in accordance with the law.

- Appraise the technical design - estimation, and task plans: The provincial land management authority is responsible for appraising the content of the technical design in the technical design - estimation, and task plans. The appraisal of cost estimates in the technical design - estimation, and task plans shall be carried out following the legal provisions on state budget management.

- Approve the technical design - estimation, task plans, and allocate funding for implementation: The competent authority is responsible for approving the technical design - estimation, and task plans, and allocating funding for implementation according to the legal provisions on budget management.

- Implement the approved technical design - estimation, and task plans, including:

+ Selecting the implementation unit: The project task owner can select the construction consultancy unit, supervision consultancy unit to execute the technical design - estimation, and task plans;

+ Developing an implementation plan;

+ Disseminating and publicizing the implementation plan;

+ Constructing the cadastral grid, control survey grid (if any);

+ Collecting information and data on parcels, land users, and land managers;

+ Determining parcel boundaries; creating boundary and marker descriptions of parcels;

+ Mapping parcel boundaries and related geographical objects;

+ Editing cadastral maps; preparing result confirmation sheets of current parcel measurements; publicizing cadastral maps;

+ Creating the land register;

+ Confirming and approving the product;

+ Submitting the product.
