Guidance on Inspecting the Implementation of Regulations on Basic Mine Construction

Circular 51/2015/TT-BTNMT guides the inspection of compliance with basic mining construction regulations; reporting the results of mineral exploitation activities; exploring and upgrading mineral reserves. To be specific:

1. Determining the time for sending registration documents/notification of the start date of basic mining construction, the start date of exploitation; submission of periodic reports on mineral exploitation activities is based on the following:

- The time indicated on the postal item or the time indicated on the receipt of the delivery organization or related documents;- The arrival date recorded in the register of incoming documents at the provincial People's Committee where the exploitation activities are conducted; from the Ministry of Natural Resources and Environment/General Department of Geology and Minerals of Vietnam for minerals under the licensing authority of the Ministry of Natural Resources and Environment.

2. Responsibility for notifying the volume and time of exploration for upgrading mineral reserves of organizations and individuals licensed to exploit minerals is based on the following:

- Notification of the plan, volume, and time of exploration for upgrading reserves within the licensed mining area to the state management agency authorized to issue permits before implementation;- Execution contract, profile of the qualifications of the implementing organization in case the mineral exploitation organization or individual does not directly implement the exploration; documents and materials storing information about the results of the exploration to upgrade reserves within the licensed mining area;- Written report and accompanying dossier submitted to the competent authority for approval of mineral reserves as prescribed.
