Guidance on formulating the Scheme and Proposal for reorganization of public service providers in Vietnam (Illustration)

According to Decree 120/2020/ND-CP, the drafting of schemes and submissions for the reorganization or dissolution of public service providers  in Vietnam is guided as follows:

1. Scheme and submission for reorganizing public service providers in Vietnam

- The content of the scheme for reorganizing a public service provider includes:

- The contents specified in Clause 2, Article 8 of this Decree;

- The current organization and operation status of the public service provider before the reorganization;

- Solutions for handling organizational structure, personnel, finance, assets, land, and other related issues;

- Documents from competent authorities and organizations confirming financial status, assets, land, loans, debts, and other related issues (if any);

- Regulations on the responsibilities of the head of the public service provider and the individuals involved in implementing the reorganization plan and the timeline for resolution.

- The content of the submission for reorganizing a public service provider is carried out as for the submission for establishing a public service provider, as stipulated in Article 9 of this Decree.

2. Scheme and submission for dissolving public service providers in Vietnam

- The content of the scheme for dissolving a public service provider includes:

- The necessity and legal basis for the dissolution;

- Solutions for handling organizational structure, personnel, finance, assets, land, and other related issues;

- Documents from competent authorities and organizations confirming financial status, assets, land, loans, debts, and other related issues (if any);

- Regulations on the responsibilities of the head of the public service provider and the individuals involved in implementing the dissolution plan and the timeline for resolution.

- The content of the submission for dissolving a public service provider is carried out as for the submission for establishing a public service provider, as stipulated in Article 9 of this Decree.

More details can be found in Decree 120/2020/ND-CP, which comes into force in Vietnam from December 01, 2020.
