Guidance on drafting legislative documents on security and order protection in Vietnam (Illustrative image)

According to Circular 66/2011/TT-BCA, the construction and issuance of legislative documents in the field of security and order protection in Vietna are carried out as follows:

1. Drafting for the Minister of Public Security to submit to the competent authority for the issuance of legislative documents in the field of security and order protection, including:

- Law, resolution of the National Assembly;

- Ordinance, resolution of the Standing Committee of the National Assembly;

- Orders, decisions of the President;

- Decrees of the Government of Vietnam;

- Decisions of the Prime Minister of the Government of Vietnam.

2. Drafting for the Minister of Public Security to issue circulars stipulating the following matters:

- Detailed regulations on the implementation of laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, decisions of the President, decrees of the Government of Vietnam, decisions of the Prime Minister of the Government of Vietnam, and other issues related to the protection of security and order or within the functions, tasks, and powers of the People's Public Security;

- Decisions on procedures, technical standards, and economic - technical norms in the People's Public Security;- Regulations on measures to implement the state management function in security and order protection and other issues assigned by the Government of Vietnam.

3. Drafting for the Minister of Public Security to chair or participate in signing, issuing inter-ministerial circulars with other Ministers, Heads of equivalent agencies, Chief Justice of the Supreme People's Court, Chief Procurator of the Supreme People's Procuracy to guide the implementation of legislative documents of higher state agencies, guide the uniform application of laws in criminal procedural activities, and other issues related to the tasks and powers of the Ministry of Public Security and those agencies.

4. Drafting for the Provincial Police Directors, centrally-administered city, Directors of the Provincial Fire Prevention and Fighting Police Department, centrally-administered city (herein referred to collectively as the Heads of Provincial-level Police) to submit to the Provincial-level People's Councils and Provincial-level People's Committees for the issuance of legislative documents in the field of local security and order protection, including:

- Resolutions of the People's Councils;

- Decisions, directives of the People's Committees.

More details can be found in Circular 66/2011/TT-BCA, which comes into effect in Vietnam from November 20, 2011.
