Regarding this issue, LawNet would like to answer as follows:

On December 23, 2023, the Ministry of Home Affairs issued Official Dispatch 7583/BNV-TCBC guiding the content of problems in developing the Project and approving job positions.

Guidance on determining job positions for civil servants and specialized employees in Vietnam

Specifically, the determination of job positions for civil servants and specialized employees will be carried out as follows:

- Regarding unification of job titles and positions of officials specialized in physical education and sports prescribed in Circular 07/2022/TT-BVHTTDL and Circular 10/2023/TT-BVHTTDL

The names of job positions guided in the 02 Circulars mentioned above have been agreed upon (In particular, the content of VTVL's description "Class IV tour guide" in Circular 10/2023/TT-BVHTTDL is mistakenly recorded as "Class IV coach" and needs to be amended and supplemented for consistency).

Therefore, it is recommended that localities, based on the guidance in the above 02 Circulars and the functions and tasks of units operating in the field of physical education and sports, develop a Project and approve employment positions and the structure of public employees according to employment positions in public service units in this field accordingly.

- Regarding guidance on employment positions in scientific research at educational institutions, medical institutions, and other public service units

Educational, medical, and other public service units assigned to perform scientific research functions and tasks are entitled to the employment positions "Researcher", "Principal Researcher" belonging to the industry and field of science and technology (stipulated in Circular 17/2023/TT-BKHCN).

- Regarding additional job positions as professional titles for accommodation service providers, restaurants, hotels, convention centers, and guest houses

It is recommended that ministries, branches, and localities apply for job positions in the office field and the fields of planning and finance (including job positions: Administration - Office; office administration; accounting; treasurer) belongs to the professional group shared in public service units (stipulated in Circular 12/2022/TT-BNV).

- Regarding additional job positions and professional titles for meritorious nursing facilities, social assistance facilities, drug addiction treatment facilities, and orthopedic and rehabilitation facilities

It is recommended that ministries, branches, and localities apply for the positions of specialized health officials (stipulated in Circular 03/2023/TT-BYT) and, at the same time, ensure compliance with the functions and tasks of the agency or unit for implementation.

- Regarding additional job positions as professional titles for the Investment Promotion Center and Tourism Promotion Center

It is recommended that ministries, branches and localities apply the job position "Trade and investment promotion" in the list of job positions and professional titles specialized in industry and trade (stipulated in Circular 07/2023/TT-BCT) and the job position "Legal support" in the list of job positions and professional titles in the judiciary (stipulated in Circular 06/2023/TT-BTP), while ensuring compliance with the functions and tasks of the Centers for implementation.

- Regarding additional job positions in the field of tourism for the Center for Monument Management and Tourism Development

It is recommended that ministries, branches, and localities apply for job positions as specialized professional titles in the fields of culture, sports, and tourism (as stipulated in Circular 10/2023/TT-BVHTTDL), while ensuring compliance with the functions and tasks of the Center for Implementation.

- Regarding job position grouping for medical secretary positions in the health industry and field: it is recommended that Ministries, branches, and localities determine the position of Medical Secretary in the list of positions with specialized professional titles (as stipulated in Circular 03/2023/TT-BYT).

- Regarding additional positions for Nursing and Midwifery level III at the Commune Health Station

It is recommended that localities use the positions of Class IV Nurse and Class IV Midwife for Commune Health Stations, ensuring compliance with regulations in Circular 03/2023/TT-BYT

- Regarding guidance on supplementing job descriptions and level frameworks to determine capacity requirements for positions holding specialized professional titles in the industry, field of labor, people with meritorious service, and society

It is recommended that localities implement uniformly according to Appendix V.5 issued with Circular 11/2023/TT-BLDTBXH.

- Regarding instructions for supplementing the job description of each job position attached to Circular 03/2023/TT-BYT

In the immediate future, it is recommended that ministries, branches and localities base on the Circulars stipulating codes and standards for professional titles in the health sector to describe the job positions of specialized health officials to suit the functions and tasks of medical facilities. The Ministry of Home Affairs will coordinate with the Ministry of Health to supplement the job description of each job position as a basis for ministries, branches, and localities to implement.

- Regarding guidance on adding job positions to Inland Waterway Port Authorities (in the field of transportation) and identify job positions for specialized professional civil servants in the transportation industry and field at the provincial and district levels

+ Job positions for specialized civil servants in the field of transportation have been fully defined in Circular 42/2022/TT-BGTVT, covering all types of transportation (including inland waterways).

Therefore, it is recommended that localities use the position of professional civil servant specialized in transportation according to the guidance of the Ministry of Transport, in which it is necessary to specify the content of the description and capacity framework of the job position in accordance with the functions, tasks, powers and organizational structure of the Inland Waterway Port Authority.

+ Based on the guidance in Circular 42/2022/TT-BGTVT, localities are requested to direct agencies and organizations in the transport sector and field at the provincial and district levels to determine the position of a professional civil servant specialized in transportation in accordance with assigned functions and tasks.
