Guidance on Declaration and Payment of Appraisal Fees for the Establishment of Execution Offices

On November 10, 2016, the Ministry of Finance issued Circular 223/2016/TT-BTC stipulating the rates, collection, submission, management, and use of fees for assessing the standards and conditions for practicing as a bailiff; fees for assessing the conditions for establishing and operating a bailiff's office.

The declaration and payment of the appraisal fee for the conditions of practicing as a bailiff, the appraisal of the conditions for establishing and operating the Bailiff Office are guided by Circular 223/2016/TT-BTC as follows:

- No later than the 5th of each month, the fee-collecting organization must transfer the collected fee of the previous month into the fee account awaiting payment to the state budget at the State Treasury.- The fee-collecting organization declares and pays the collected fee monthly, and carries out the annual settlement as guided in Clause 3, Article 19, Clause 2, Article 26 of Circular 156/2013/TT-BTC.

According to Circular 223, the fee-collecting organizations include:

- The Judicial Support Department, which collects the appraisal fee for the standards and conditions of practicing as a bailiff.- The Department of Justice of the provinces and centrally-run cities where the appraisal of the conditions for establishing and operating the Bailiff Office is conducted, collects the fees according to regulations.
