Recently, the Ministry of Health has provided guidance on conducting medical assessments for consideration for recognizing and settling preferential policies for people with meritorious services in Vietnam.

On June 28, 2024, the Ministry of Health issued Official Letter 3619/BYT-KCB on conducting medical assessments for consideration for recognizing and settling preferential policies for people with meritorious services and their relatives in Vietnam.

Implementing Decree 131/2021/ND-CP dated December 30, 2021, issued by the Government of Vietnam detailing regulations and measures for the implementation of the Ordinance on Preferences for People with Meritorious Services to the Revolution, the Ministry of Health requests units to conduct medical assessments as a basis to consider recognizing and resolving preferential regimes for people with meritorious services to the revolution and their relatives according to the detailed guidance provided in Decree 131/2021/ND-CP and other relevant guiding documents, specifically:

(1) Medical assessments to determine injuries, diseases for the wounded, war invalids, type-B war invalids, people receiving policies as war invalids, diseased soldiers, and relatives of people with meritorious services to the revolution, and to identify diseases, deformities, and abnormalities related to exposure to chemical toxins for resistance activists and their birth children are conducted according to the provisions of Decree 131/2021/ND-CP dated December 30, 2021, issued by the Government detailing the regulations and measures to implement the Ordinance on Preferences for People with Meritorious Services to the Revolution.

(2) Documentation, diagnosis, and medical assessment for diseases, deformities, and abnormalities related to exposure to chemical toxins; Methods for synthesizing the percentage of body impairment follow the following regulations:

* Medical assessment documentation

  • A summary of the medical record, surgical certificate prepared as per Form No. 2 and Form No. 52 in Appendix XXIX attached to Circular 32/2023/TT-BYT dated December 31, 2023, issued by the Ministry of Health guiding certain articles of the Law on Medical Examination and Treatment.

  • Hospital discharge paper prepared according to the provisions in Appendix 3 attached to Circular 18/2022/TT-BYT dated December 31, 2022, issued by the Ministry of Health amending and supplementing some articles of Circular 56/2017/TT-BYT dated December 29, 2017, issued by the Ministry of Health detailing the implementation of the Law on Social Insurance and the Law on Occupational Safety and Health under the health sector.

* Diagnosis of diseases, deformities, and abnormalities related to exposure to chemical toxins according to the guidance in Decision 3201/QD-BYT dated June 29, 2016, issued by the Ministry of Health approving the specialized document “Guidelines for diagnosing diseases, deformities, and abnormalities related to exposure to chemical toxins/dioxin.”

* Medical assessment for diseases, deformities, and abnormalities related to exposure to chemical toxins according to the guidance in Decision No. 4779/QD-BYT dated December 30, 2023, issued by the Ministry of Health approving the guidelines for medical assessment for diseases, deformities, and abnormalities related to exposure to chemical toxins/dioxin based on the document attached to Decision 3201/QD-BYT dated June 29, 2016, issued by the Ministry of Health.

* Method for synthesizing the percentage of body impairment is conducted according to the provisions of Article 168 of Decree 131/2021/ND-CP dated December 30, 2021, issued by the Government detailing the regulations and measures to implement the Ordinance on Preferences for People with Meritorious Services to the Revolution and Joint Circular 28/2013/TTLT-BYT-BLDTBXH dated September 27, 2013, issued by the Minister of Health and the Minister of Labor - Invalids and Social Affairs of Vietnam, regulating the percentage of body impairment due to injuries, diseases, and occupational diseases.
