Regarding this issue, LawNet would like to answer as follows:

On February 24, 2024, the Minister of Home Affairs issued Circular 1/2024/TT-BNV taking effect on April 25, 2024, on implementing the Law on Emulation and Commendation and Decree 98/2023/ND-CP.

1. Guidance on commendation for individuals and groups of party agencies and unions in Vietnam as of April 25, 2024

Commendation for individuals and groups of party agencies and unions in Vietnam are as follows:

Individuals and groups specializing in party and union work: Whichever level manages the organization, officials, public employees, employees, and salary funds, that level will consider and decide on rewards or submit them to superiors for rewards.

- Individuals and groups in charge of party and union work in ministries, departments, branches, and central unions: the place that directly manages officials, and the salary fund reviews and decides on rewards or submits them to superiors for rewards;

- Individuals and collectives in charge of party and union work at the provincial level, directly managed by party agencies and unions, consider and propose to the Chairman of the Provincial People's Committee to reward or submit to superiors for reward;

- Individuals and groups specializing in party and union work at the district level: Party agencies and organizations directly managed consider and propose the Chairman of the District People's Committee to reward or the Chairman of the District People's Committee to submit to the Chairman of the Provincial People's Committee for reward or submit to superiors for reward;

- The Vietnam General Confederation of Labor rewards and submits rewards to superiors for: Departments, public service units, and enterprises under the union system; Labor Confederations of provinces and centrally run cities; Central Industry Union and equivalent; The Corporation's Trade Union belongs to the General Confederation; District Labor Federation; Provincial-level industry trade unions, provincial-level employee unions, trade unions of industrial parks, export processing zones, economic zones, and high-tech zones; Trade Unions of Corporations and equivalent; Grassroots unions and specialized union officials receive salaries from the union finances of the above units.

2. Responsibility in receiving reward applications in Vietnam

According to Article 8 of Circular 1/2024/TT-BNV, the responsibility for receiving reward applications; issuing, exchanging, and reissuing reward items; and preparing reward artifacts and other emulation and reward tasks is as follows:

- Reward request documents of ministries, departments, branches, and provinces submitted to the Prime Minister according to the provisions of Clauses 12 and 14, Article 30 of Decree 98/2023/ND-CP sent to the Ministry of Home Affairs
(through the Central Emulation and Commendation Committee) to comply with regulations.

- Application requesting exchange or re-issuance of State-level commendation artifacts according to the provisions of Article 114 and Article 115 of Decree 98/2023/ND-CP sent to the Ministry of Home Affairs (through the Central Emulation and Commendation Board ) to comply with regulations.

The Ministry of Home Affairs (Central Emulation and Commendation Board) is responsible for procuring, preserving, and distributing State-level commendation items according to the provisions of Clause 1 of Article 113 of Decree 98/2023/ND-CP, and relevant laws.

- The Central Emulation and Commendation Committee advises and assists the Ministry of Home Affairs in carrying out the tasks of the standing agency of the Central Emulation and Commendation Council according to the provisions of Clause 5 of Article 47 of Decree 98/2023/ND-CP.
