Guidance on Cases Requiring Mandatory Procurement Certificates

The Ministry of Planning and Investment has provided guidance on cases where it is mandatory and not mandatory to have operational certificates in the field of bidding. The contents of the guidance are mentioned in Official Dispatch 2683/BKHDT-QLDT.

Individuals directly involved in tasks such as: preparing expressions of interest dossiers, prequalification invitation documents, bidding documents, requirement documents; evaluating expressions of interest, prequalification bids, tender bids, proposals within professional bidding organizations, enterprises, bidding consultancy units, professional project management boards, and simultaneously belonging to one of the following units must obtain a professional certificate in bidding activities, including:

- Individuals belonging to professional project management boards: specialized project management boards, regional project management boards according to construction law or project management boards established to perform professional project management tasks; dedicated individuals undertaking project management tasks without concurrent duties belonging to project management boards established to undertake multiple projects simultaneously or successive projects, following one project after another;- Individuals belonging to enterprises operating in the field of bidding consultancy, units operating in the field of bidding consultancy (engaging in bidding consultancy);- Individuals belonging to dedicated central procurement units (agencies, organizations established to perform dedicated central procurement for their respective agencies, organizations, frequently and continuously engaging in procurement), except individuals mentioned at point c, Section 2 of Official Dispatch 2683/BKHDT-QLDT.

Moreover, in Official Dispatch 2683/BKHDT-QLDT, it is also clearly stated that individuals who are not required to obtain a professional certificate in bidding activities (but must have a training certificate in bidding) include:

- Individuals belonging to project management boards established to undertake a specific project, which will dissolve after the project concludes;- Individuals belonging to departments of Bureau, Department, Office, district, state-owned enterprises... directly involved in the tasks stated in Clause 7, Article 35 of Circular 03/2016/TT-BKH according to assigned duties and not professionally active in the field of bidding;- Individuals directly involved in the tasks stated in Clause 7, Article 35 of Circular 03/2016/TT-BKHDT in central procurement under a part-time model, not frequently or continuously, and not professionally, dedicatedly active in the field of bidding.

Additionally, in the future (expected from July 2018), information related to organizing professional certificate examinations in bidding and registration for the examination will be available and conducted online. Individuals wishing to take the examination will register directly on the National Bidding Network System at the websites muasamcong.mpi.gov.vn, dauthau.mpi.gov.vn.
