Guidance on Advance Payment and Settlement for Publishing Order Contracts for Press Publications

The Ministry of Finance has issued Circular 73/2019/TT-BTC regulating the management and use of funds to implement the policy of providing certain newspapers and magazines to ethnic minority and mountainous areas, particularly difficult regions for the period of 2019-2021.

According to Article 5 Circular 73/2019/TT-BTC, it is stipulated that based on the estimates approved by the competent authority; the contract for ordering the publication and distribution of some materials for ethnic minority and mountainous areas, extremely difficult areas between the Committee for Ethnic Minority Affairs and the respective newspaper, magazine, and distribution units, the Committee for Ethnic Minority Affairs shall implement:

- An initial advance for the newspaper, magazine, and distribution units immediately after signing the contract, amounting to 30% of the annual contract value;- Subsequent advances for the newspaper, magazine, and distribution units: The number of advances, timing of advances, and amount of each advance shall be implemented as agreed upon in the contract, based on the contract implementation schedule, but the total amount of advances (including the initial advance and subsequent advances) shall not exceed 80% of the contract value and must not exceed the annual estimate approved by the competent authority.

Upon the completion of the year, the newspaper, magazine, and distribution units shall compile the implementation status of the contract by January 10 of the following year and submit it to the Committee for Ethnic Minority Affairs. Within 10 working days from the date of receiving all documents from the newspaper, magazine, and distribution units, the Committee for Ethnic Minority Affairs shall be responsible for organizing the inspection, contract liquidation, and final payment of any remaining contract value (if any) to the newspaper, magazine, and distribution units.

The payment of the publication and distribution contracts shall be carried out according to the regulations in Decree 32/2019/ND-CP.

Additionally, the Committee for Ethnic Minority Affairs is responsible for providing records and documents to the local State Treasury when requesting payment in accordance with the provisions of Circular 161/2012/TT-BTC on October 2, 2012, by the Ministry of Finance, which stipulates policies on payment control and budget expenditure through the State Treasury, and Circular 39/2016/TT-BTC on March 1, 2016, which amended and supplemented a number of provisions of Circular 161/2012/TT-BTC on October 2, 2012, by the Ministry of Finance. The newspaper, magazine, and distribution units shall directly retain the related expenditure documents according to current regulations.
