Guidance on Adjusting the Contract for Implementing a Ministry of National Defense Project

Accordingly, the adjustment of contracts for the implementation of projects under the Ministry of National Defense is stipulated by Circular 84 as follows:

- The unit in charge of implementing the project is allowed to proactively adjust the cost estimates within the total allocated budget as per current regulations.- Any adjustments regarding the unit in charge of the project, objectives, products, and the total funding support from the state budget that has been approved will be reviewed and decided by the Minister of National Defense based on the proposal of the project management agency.- The Minister of National Defense authorizes the Director of the Department of Military Science to decide on adjustments to other contents within the scope of the signed contract based on the written proposals from the project management unit.

It should be noted that the adjustment to the project implementation time is only allowed once for each project. The extension period is not more than 12 months for projects with an implementation time of 24 months or more and not more than 06 months for projects with an implementation time of less than 24 months. In special cases, the decision will be made by the Minister of National Defense. The extension of the project implementation time will only be considered at least 01 month before the contract ends.

In particular, when necessary, the project management agency shall seek the opinions of the proposing agency, unit, and relevant agencies before deciding to adjust the contract.
