On June 21, 2024, the Minister of Public Security of Vietnam issued Circular 26/2024/TT-BCA stipulating the statistics, compilation, construction, management, exploitation, and use of the Database on road traffic accidents, railway traffic accidents, and inland waterway traffic accidents.
Article 12 of Circular 26/2024/TT-BCA stipulates the group of statistical indicators on road vehicles in Vietnam from August 15, 2024, as follows:
The group of indicators on road motor vehicles includes both the vehicles causing and the vehicles related to the traffic accident.
(1) Types of vehicles
- Road motor vehicles include: cars; tractors; trailers or semi-trailers towed by cars or tractors; two-wheeled motorcycles; three-wheeled motorcycles; mopeds (including electric bikes) and similar vehicles;
- Road rudimentary vehicles include: bicycles (including motorbikes, electric bicycles), tricycles, wheelchairs for the disabled, animal-drawn vehicles, and similar vehicles;
- Special-use motorcycles include: construction motorcycles, agricultural, forestry motorcycles, and other special vehicles used for national defense and security purposes participating in road traffic.
(2) Condition of the vehicle before the occurrence of the traffic accident
- Vehicle registration: yes or no, registration certificate number, license plate number, license plate color, brand, type, vehicle owner's name (individual or organization), registration address;
- Technical safety and environmental protection inspection: yes or no, inspection certificate number, inspection unit, inspection validity, inspection cycle, year of manufacture, mileage on the odometer;
- Compulsory civil liability insurance for motor vehicle owners: yes or no, certificate number, insurance validity period;
- Number of people, goods carried on the vehicle (if any): type of goods, weight, size;
- Technical safety condition of the vehicle (steering system, braking system, transmission system, electrical system, lighting, signals, and other safety equipment) maintained, repaired on schedule or not.
(3) Condition of the vehicle after the occurrence of the traffic accident: still operable, inoperable; number of airbags deployed; burned, exploded.
Statistics, compilation, and construction of the Database on traffic accidents must ensure the following principles:
- Ensure objectivity, honesty, accuracy, completeness, promptness, in accordance with the progress of investigation, verification, resolution of traffic accidents, and other professional requirements.
- Uniformity in statistical indicators, statistical forms; with analysis and comparison.
- No duplication or overlap between statistical information; must fully record required information fields according to the traffic accident report form stipulated in Clause 1, Article 27 of Circular 26/2024/TT-BCA.
- One or multiple continuous collisions between traffic participants at a particular location are considered a traffic accident. A traffic accident involves one or multiple traffic participants.
- Statistics on the number of deaths in a traffic accident include people who die and people injured by the traffic accident leading to death within 07 days from the date of the traffic accident; in case where a person injured by the traffic accident leads to death beyond 07 days from the date of the traffic accident and has a conclusion from a public forensic examination organization, additional statistics shall be made.
- Statistics on the number of injuries in a traffic accident include those who were injured and required treatment, with medical records from a medical examination and treatment facility.
- In case the traffic accident data previously reported has errors or new cases, deaths, injuries arise outside the reporting period, additional statistics and explanations for adjustments must be made. Provincial police compile and report to the Ministry of Public Security (via the Traffic Police Department).
- No infringement on national interests, rights, or legitimate interests of agencies, organizations, individuals.
