According to the Circular 10/2007/TT-BTC, goods listed in the Goods List originating from the Free Trade Zone in Phu Quoc Island are exempt from customs procedures but must declare the quantity of goods with customs authorities and be supervised by customs authorities.
For other goods, full customs procedures must be performed. To be specific:
- Organizations and individuals engaged in business and production in the free trade zone (the seller) are responsible for providing organizations and individuals engaged in business and production within the domestic market (the buyer) with complete documents, invoices, and other papers as required by customs authorities so that domestic enterprises can declare customs, and submit customs dossiers in accordance with the relevant import type at Gate B customs authority.
- Gate B customs authority is responsible for completing customs procedures for imported goods of domestic enterprises in accordance with the relevant import type. If it is discovered that foreign goods are brought into the free trade zone to continue to be imported into the domestic market, which belongs to the same type as the goods listed in the Goods List originating from the free trade zone as notified by the Management Board, but the enterprise does not declare customs, then Gate B customs authority shall require the presentation of documents proving the origin of the goods; handle violations and complete import procedures for goods according to the law; at the same time, notify the Management Board to take management measures or exclude from the Goods List originating from the free trade zone.
