Goods in Transit from China through Vietnam are Not Permitted for Consumption within Vietnamese Territory

This is a noteworthy provision stipulated in Circular 11/2015/TT-BCT on the transit of goods from the People's Republic of China through the territory of Vietnam, issued by the Minister of Industry and Trade on June 4, 2015.

Article 15 Circular 11/2015/TT-BCT clearly stipulates the consumption of goods in transit from China through the territory of Vietnam. To be specific:

1. Goods in transit are not allowed to be consumed within the territory of Vietnam.

2. In special cases, the consumption of goods in transit within the territory of Vietnam must be approved by the Ministry of Industry and Trade.

3. The consumption of goods in transit in the cases mentioned in Clause 2 of this Article must be conducted through Vietnamese traders and must complete import procedures at Customs authorities in accordance with the legal regulations on import and export management. Taxes shall be applied according to legal regulations.

4. Documents required for the application for permission to consume goods in transit:

- Application for permission to consume goods in transit from the owner: 01 (one) original copy (as per the form stipulated in Appendix IV issued with this Circular);- Issued transit goods permit: 01 (one) copy (certified and stamped by the goods owner);- Documents proving the special case for transit goods that need to be consumed in Vietnam;- Confirmation document from Customs authorities regarding the status of the transit goods: 01 (one) original copy;- Customs declaration for the transit goods: 01 (one) copy (certified and stamped by the goods owner).

5. Procedures and timeframe for processing the application for permission to consume goods in transit are as follows:

- The owner shall send 01 (one) set of documents as stipulated in Clause 4 of this Article by post to the Ministry of Industry and Trade (Department of Import and Export, address: 54 Hai Ba Trung, Hoan Kiem District, Hanoi, Vietnam) for review and resolution to consume goods in transit;- The processing time for the application for permission to consume goods in transit is within 15 working days from the date of receiving a complete and valid application;- In case the application is incomplete or invalid, within 07 working days from the date of receiving the application, the Ministry of Industry and Trade shall issue a written request for the owner to supplement or correct the application;- In case of refusal to allow the consumption of goods in transit, the Ministry of Industry and Trade shall issue a written response to the owner stating the reasons.
