General provisions on economic - technical norms for conservation and development services of ethnic sports in Vietnam

From January 1, 2025, general regulations on economic-technical norms for services in the conservation and development of ethnic sports in Vietnam will be implemented in accordance with Circular 11/2024/TT-BVHTTDL.

On November 7, 2024, the Minister of Culture, Sports and Tourism of Vietnam issued Circular 11/2024/TT-BVHTTDL regulating the economic - technical benchmarking for services related to the conservation and development of ethnic sports.

General provisions on economic - technical norms for conservation and development services of ethnic sports in Vietnam

The economic - technical benchmark for the conservation and development of ethnic sports services must ensure general regulations as follows:

(1) The economic - technical benchmark stipulated in Circular 11/2024/TT-BVHTTDL represents the maximum level, ensuring accuracy and sufficiency in fulfilling public service provision tasks according to criteria and quality standards.

(2) The economic - technical benchmark regulated in this Circular serves as a basis for:

- Identifying job titles in the labor component to calculate labor costs, establishing expenditure content and budgeting for the provision of public services using state budgets, and submitting to competent authorities for approval and annual funding arrangement;

- Determining unit costs and service fees for public services using state budgets that are ordered in accordance with Decree 32/2019/ND-CP, regulating the assignment of tasks, ordering or bidding for the provision of products, public services using regular expenditures from the state budget.

(3) Determining labor titles:

- Labor titles in the labor cost component of the benchmark table are applied according to Decree 204/2004/ND-CP on salary policies for officials and public employees and armed forces; Decree 117/2016/ND-CP amending and supplementing a number of articles of Decree 204/2004/ND-CP on salary policies for officials and public employees, armed forces; or considering equivalent conversion according to job positions approved by competent authorities; Circular 07/2022/TT-BVHTTDL on regulations for code numbers, standards for professional titles, salary ranking for public employees in physical education and sports.

- In cases where the rank level of labor titles at agencies, organizations does not conform to the table of standards, the competent authority considers and decides the application of the rank levels prescribed in the benchmarks, equivalent grades, or specifies the rank levels at which labor is working and corresponding actual cost.

In these cases, labor cost must not exceed the labor cost calculated from the standard issued by the Minister of Culture, Sports, and Tourism. Officials and public employees participating in work receiving salaries from the state budget are not entitled to the policies specified in Circular 11/2024/TT-BVHTTDL.

Contents of economic - technical levels for conservation and development of ethnic sports services in Vietnam 

According to Clause 1, Article 3 of Circular 11/2024/TT-BVHTTDL, the contents of the economic - technical levels include:

- Labor costs: This refers to the necessary direct and indirect labor time of average grade levels to complete the implementation of a service. The indirect labor cost is calculated based on 15% of the corresponding direct labor.

- Machinery and equipment usage costs: This is the time required for machinery and equipment usage in delivering public service tasks, calibrated in machine use shifts, each equal to 1 working day (8 hours) as per Article 105 of the Labor Code.

- Material use costs: This is the specific and necessary quantity of materials used directly to provide public services.
