Regarding this matter, LawNet would like to answer as follows:
On March 22, 2024, the Director General of the Social Insurance of Vietnam issued Decision 316/QD-BHXH regulating the function, duties, powers, responsibilities, and management regime of the departments under the Social Insurance Inspectorate of Vietnam.
According to Article 3 of Decision 316/QD-BHXH in 2024, the function, duties, and powers of the Department of Inspection of social insurance and unemployment insurance contributions in Vietnam (referred to as Department 3) are as follows:
1. Position and function
Department 3 is a unit under the Social Insurance Inspectorate of Vietnam with the function of advising and assisting the Chief Inspector in managing inspection work, implementing specialized inspections in the field of social insurance and unemployment insurance, and carrying out tasks related to administrative sanctions for violations of laws on social insurance and unemployment insurance.
2. Duties and powers
- Advise and assist the Chief Inspector
+ Conduct specialized inspections in the field of social insurance, unemployment insurance; impose administrative sanctions for violations of laws on social insurance and unemployment insurance; enforce the execution of administrative penalties for violations of laws on social insurance, unemployment insurance according to the regulations of the law;
+ Direct inspection work; guide the inspection procedures for Provincial Social Insurance;
+ Direct, guide, and urge Provincial Social Insurance to enforce administrative penalties for violations discovered through inspections;
+ Submit proposals for prosecution to competent authorities to initiate litigation for criminal acts in the fields of social insurance, unemployment insurance, and health insurance discovered through inspections, examinations;
+ Re-inspect cases that have been concluded by the Director of Provincial Social Insurance but found to have signs of law violations;
+ Verify the accuracy and legality of inspection conclusions made by the Director of Provincial Social Insurance and make decisions on inspections when necessary;
+ Handle recommendations regarding the content of inspection conclusions from the inspected entities and related agencies, organizations, and individuals according to the assigned duties and tasks.
- Report the results of inspections on social insurance, unemployment insurance; report the results of administrative sanctioning for violations of laws on social insurance, unemployment insurance; be responsible for the data of assigned business software, hierarchical management, exploitation, and utilization.
- Participate in planned and surprise inspections.
- Carry out tasks: scientific research; administrative reform; emulation, commendation; apply quality management system according to national standards TCVN; disseminate policies, laws on social insurance, unemployment insurance, health insurance; international cooperation; apply information technology, digital transformation; train and specialize in professional skills according to assigned duties and tasks.
- Coordinate with departments under the Social Insurance Inspectorate of Vietnam in the process of performing tasks.
- Manage inspectors, employees, contract workers, and assets of the department according to regulations.
- Perform other tasks assigned by the Chief Inspector.
