Full Text of Regulations on Issuance of Import Licenses under Tariff Quota

Recently, Circular 12/2018/TT-BCT was issued by the Ministry of Industry and Trade, detailing certain provisions of the Law on Foreign Trade Management and Decree 69/2018/ND-CP. The document takes effect from June 15, 2018.

Circular 12 prescribes the issuance of Import Licenses under tariff quotas as follows:

1. Based on the annual published tariff quota quantity and merchant registration, the Ministry of Industry and Trade considers issuing Import Licenses under tariff quotas to merchants.

2. Dossier for the issuance of Import Licenses under tariff quotas:

- Import quota registration form: 1 original copy.- Investment Certificate or Business Registration Certificate or Enterprise Registration Certificate: 1 copy stamped by the merchant.

3. Process for the issuance of Import Licenses under tariff quotas:

- Merchants submit 1 dossier directly or by post or online (if applicable) to the Ministry of Industry and Trade, at the address: 54 Hai Ba Trung, Hoan Kiem District, Hanoi.- In case the dossier is incomplete, not conformable or requires additional explanatory documents, within 3 working days from the date of receipt of the dossier, the Ministry of Industry and Trade will notify the merchant for dossier completion.- The time limit for resolving the issuance of Import Licenses under tariff quotas to merchants is within 10 working days, from the time of allocation and receipt of a complete, conformable dossier by the Ministry of Industry and Trade. In case of non-issuance, the Ministry of Industry and Trade will reply to the merchant in writing, stating the reasons.

4. Merchants are responsible for reporting quarterly or unexpectedly on the import situation upon request by the Ministry of Industry and Trade.

- Before September 30 each year, merchants shall report to the Ministry of Industry and Trade assessing the annual import capability, requesting an adjustment to increase or decrease the granted import quota or reporting quantities of goods that cannot be imported to be allocated to other merchants.
