Full inspection contents must be sent to unit using and managing officials and Public Employees in Vietnam

Recently, the Ministry of Interior issued Decree 39/2007/ND-CP stipulating the procedures and contents of inspections concerning the recruitment, utilization, and management of officials and public employees in Vietnam.

According to Article 7 of Circular 09/2012/TT-BNV, it is stipulated that no later than 15 days from the date of signing the inspection decision, the Head of the Inspection Team shall announce the inspection decision according to the time and place notified to the inspection target. When announcing the inspection decision in Vietnam, the Head of the Inspection Team is responsible for:

- Fully announcing the content of the inspection decision and clearly stating the purpose, requirements, methods, and working procedures of the Inspection Team, the rights and obligations of the Inspection Team and the inspection target, the inspection implementation plan, and the direct inspection schedule at the agency, unit being inspected; requiring the agencies, organizations, units being inspected to prepare and provide relevant documents related to the inspection content;- The Inspection Team requests the head of the agency or unit being inspected to directly report on the inspection contents according to the sent outline. After listening to the inspection target's prepared report, if it is deemed necessary, the Head of the Inspection Team may request the inspection target to continue to supplement and complete the report.

The announcement of the inspection decision must be recorded in minutes and signed between the representative of the Inspection Team and the representative of the leadership of the agency or unit being inspected.

In addition, the inspection team conducts direct inspections at the agencies or units being inspected according to the direct inspection schedule agreed between the Inspection Team and the inspection target. Conducting direct inspection includes:

- Receiving the report from the inspection target, listening to the inspection target's report; researching, analyzing, contrasting, comparing, and evaluating the report documents of the inspection target and the collected information, documents, and records; requiring the inspection target to explain issues related to the inspection content;

- During the direct inspection process in Vietnam, if deemed necessary, the Inspection Team shall work with officials and public employees or related persons to verify the inspected content and take responsibility for the accuracy and objectivity of the verified information and documents;

- After completing the inspection and verification at each agency in Vietnam, unit being inspected, and related agencies, units, or individuals, the Inspection Team shall record the process in minutes and preliminarily announce the results, providing an overall assessment of the implementation of legal regulations related to the inspection content.

Note: During the inspection, due to the requirements of the Inspection Team or requests from the inspection target, the direct inspection schedule may be adjusted or changed. Any adjustment or change in the direct inspection schedule must be notified to the inspection target and reported to the person who made the inspection decision.
