On October 05, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating the conditions for investment and operation in the field of education.

From November 20, 2024, what are conditions for other educational institutions in Vietnam to implement the general education curriculum at the primary education level?

According to the Article 22 of Decree 125/2024/ND-CP, other educational institutions in Vietnam must meet the following conditions to implement the general education curriculum at the primary education level:

- Have a team of management staff and teachers meeting the standards to ensure the implementation of the general education curriculum at the primary education level.

- Classrooms must ensure proper standards, safety for teachers and students in accordance with school hygiene regulations; ensure conditions for disabled students to access and use according to the regulations of the Ministry of Education and Training.

- Have equipment, teaching and learning materials suitable for the general education curriculum at the primary education level.

What are procedures for other educational institutions in Vietnam to implement the general education curriculum at the primary education level?

Article 23 of Decree 125/2024/ND-CP stipulates the procedures for other educational institutions in Vietnam to implement the general education curriculum at the primary education level as follows:

- The Chairman of the commune-level People's Committee decides to allow other educational institutions to implement the general education curriculum at the primary education level.

- The dossier includes:

+ A proposal to allow the implementation of the general education curriculum at the primary education level (according to Form 09 of Appendix I attached to Decree 125/2024/ND-CP);

	Form 09

+ A document confirming sponsorship by a primary school in the same district.

- Implementation process:

+ Organizations or individuals submit 01 set of dossiers as prescribed in Clause 2, Article 23 of Decree 125/2024/ND-CP through the online public service portal, post, or directly to the commune-level People's Committee;

+ Within 05 working days from the date of receiving the dossier, if the dossier is not valid, the commune-level People's Committee will notify the organization or individual in writing;

+ Within 10 days from the date of receiving a complete and valid dossier, the Chairman of the commune-level People's Committee considers and decides on allowing other educational institutions to implement the general education curriculum at the primary education levels.

The decision to allow other educational institutions to implement the general education curriculum at the primary education level (according to Form 10 of Appendix I attached to Decree 125/2024/ND-CP) is announced publicly on mass media.

What are regulations on suspension, revocation of the decision to allow other educational institutions in Vietnam to implement the general education curriculum at the primary education level?

Article 24 of Decree 125/2024/ND-CP stipulates the suspension and revocation of the decision to allow other educational institutions to implement the general education curriculum at the primary education level as follows:

- The suspension of other educational institutions implementing the general education curriculum at the primary education level is carried out as for primary schools according to the provisions of Article 19 of Decree 125/2024/ND-CP.

- The revocation of the decision to allow other educational institutions to implement the general education curriculum at the primary education level is carried out as follows:

+ The Chairman of the commune-level People's Committee shall revoke the decision to allow other educational institutions to implement the general education curriculum at the primary education level;

+ Other educational institutions will have their permission revoked when falling into one of the following cases:

The  educational  institution  is  dissolved  according  to  the  provisions  of  the  law;

Severe  violations  of  regulations  on  the  organization  and  operation  of  educational  institutions;

The  suspension  period  has  expired  without  correcting  the  cause  of  suspension;

The  objectives  and  content  of  educational  activities  of  the  educational  institution  no  longer  meet  the  local  socio-economic  development  requirements;

At  the  request  of  the  organization  or  individual  that  proposed  the  establishment  of  the  educational  institution;Other  cases  as  prescribed  by  law;

+ The revocation of the decision to allow other educational institutions to implement the general education curriculum at the primary education level must clearly identify the reason for revocation, the measures to ensure the legal rights and interests of students, teachers, management staff, and employees, and is publicly announced on mass media.

Refer to the Decree 125/2024/ND-CP (effective from November 20, 2024).

Decree 125/2024/ND-CP replaces Decree 46/2017/ND-CP stipulating the conditions for investment and operation in the field of education and Decree 135/2018/ND-CP amending and supplementing some articles of Decree 46/2017/ND-CP on the conditions for investment and operation in the field of education.
